The Minister of Public Security has just signed and issued Circular 53/2025/TT-BCA amending Circular 55/2021/TT-BCA guiding the 2020 Law on Residence; Circular 56/2021/TT-BCA regulating forms in registration, residence management..., effective from July 1, 2025.
Notably, Clause 5, Article 1 of Circular 53/2025/TT-BCA amended and supplemented Article 24 of Circular 55/2021/TT-BCA regulating the responsibilities of the Commune-level Police.
Accordingly, the Commune-level Police perform the responsibilities prescribed in Article 33 of the Law on Residence.
Article 33 of the Law on Residence stipulates the responsibilities of the residence registration agency, specifically as follows:
Publicly post administrative procedures; guide agencies, organizations, individuals and households to comply with legal regulations on residence; publicize locations, phone numbers or other methods to receive residence notifications and temporary absence declarations.
Update information on citizens' residence in the National Population Database and Residence Database.
Confirm information on residence, notify results of procedures for permanent residence registration, temporary residence registration, temporary residence extension, information declaration, adjustment of information on residence, household separation, temporary absence declaration in the form of documents, electronic messages or other forms as prescribed by the Minister of Public Security.
Manage, store records, papers, documents on registration, residence management and secure information on citizens' residence registration.
Resolve citizens' petitions, complaints and denunciations related to residence and residence management according to authority.
In addition, the Commune Police are responsible for collecting, updating and editing citizen information in the Residential Database and the National Population Database according to their authority.
At the same time, coordinate with agencies, organizations and individuals directly managing road, railway and inland waterway vehicles providing passenger transport services in the management area to review and compile statistics on the residence status of drivers and employees on these vehicles to serve the work of residence management and crime prevention.
In addition, the Commune Police are responsible for performing other tasks related to residence management according to regulations of the superior Police.
Notably, Circular 53/2025/TT-BCA has added regulations that the Commune Police are allowed to periodically and suddenly conduct residence checks.
According to Article 25 of Circular 55/2021/TT-BCA, residence checks are conducted periodically, suddenly or due to the requirements of crime prevention and control, security and order assurance.
Subjects and areas of residence inspection are citizens, households, dormitories, student housing areas, student housing areas, worker housing areas, rental houses, houses for loan, houses for temporary stay of organizations, individuals, belief establishments, religious establishments, social assistance establishments, medical treatment establishments, tourist accommodation establishments and other establishments with accommodation functions; residence registration agencies at all levels; agencies and organizations related to residence management.
The contents of residence inspection include inspection of the implementation and organization of registration and management of residence, collection, update and exploitation of residence information in the Residence Database; rights and responsibilities of citizens, households, agencies and organizations; other contents according to the law on residence.
The residence registration and management agency shall inspect the compliance with the law on residence of citizens, households, agencies and relevant organizations. When inspecting, it is entitled to mobilize the masses to do security and order protection work at the grassroots level, and to protect agencies, enterprises and organizations. In case a superior agency conducts an inspection, it must coordinate with the lower-level residence registration agency.
