From January 1, 2025, motorcycles and motorbikes will have to have their emissions tested.

Law on Road Traffic Order and Safety takes effect from January 1, 2025

Article 42 of the Law on Road Traffic Order and Safety (TTATGT) stipulates the technical safety and environmental protection (ATKT & BVMT) of motor vehicles and specialized motorbikes participating in road traffic, stating: Inspection of motorbikes and mopeds only includes emission inspection. Thus, from the time this Law takes effect (January 1, 2025), motorbikes and mopeds will have to undergo emission inspection.

The Law also stipulates that emission testing must comply with the provisions of the law on environmental protection and must be carried out at emission testing facilities that meet national technical regulations.

In big cities, motorbikes are still the main means of transport. According to statistics in 2020, motorbikes and motorbikes in circulation in Hanoi accounted for 84%, in Ho Chi Minh City accounted for 91% and in Da Nang accounted for 90% of all types of transport. In the period of 2025-2030, motorbikes will still be a popular and common form of personal transport, however, this is also the means of transport that emits the largest amount of emissions into the environment in big cities.

MSc. Dinh Trong Khang, Deputy Director of the Institute of Environment, Institute of Transport Science and Technology, said that research results during the process of measuring motorbike emissions showed that if vehicle users perform periodic maintenance according to the manufacturer's recommendations, they can control emissions well and reduce the vehicle's fuel consumption (7%).

Controlling motorcycle and motorbike emissions also helps reduce 35.55% of total CO emissions and 40% of total HC emissions, thereby improving the quality of life.

Also according to the new law, the Minister of Transport will prescribe the procedures for granting new, re-granting, temporarily suspending operations, and revoking certificates of eligibility to operate for facilities testing emissions of motorbikes and mopeds.

The Minister also stipulates the order and procedures for inspection of motorcycle and motorbike emissions; national technical regulations on technical facilities and locations of motor vehicle inspection facilities and motorcycle and motorbike emission inspection facilities.

Many new regulations on child safety protection

In addition, the Law on Road Traffic Order and Safety also adds many new regulations to protect the safety of children when traveling on motorbikes and cars.

The law stipulates that when transporting children under 10 years old and under 1.35m tall in a car, children must not sit in the same row of seats as the driver, except for cars with only one row of seats.

Drivers must use and instruct in the use of appropriate child safety equipment.

The law also stipulates that family members are responsible for disseminating and reminding other members to comply with the law on road traffic order and safety, use seat belts, child seats or have an adult sit with the child in the back when transporting children under 6 years old by motorbike or scooter.

Along with that, the new law also adds regulations related to school buses. In particular, commercial vehicles transporting preschool children and students, in addition to ensuring the conditions according to regulations, must have equipment to record images of preschool children and students and equipment with warning functions to prevent children from being left behind in the vehicle.

At the same time, the vehicle must be no more than 20 years old and have a paint color according to Government regulations.

Cars carrying preschool children or primary school students must have age-appropriate seat belts, or use vehicles with age-appropriate seats as required by law.

Vehicles used for transportation combined with activities of picking up and dropping off preschool children and students must meet the requirements, and have equipment to record images of children, equipment with warning functions, and equipment to prevent children from being left in the vehicle that meets the requirements for vehicle equipment.

When picking up and dropping off preschool children and primary school students, there must be at least one manager on each vehicle to guide, supervise, maintain order and ensure the safety of preschool children and primary school students throughout the trip.

In case a vehicle has 29 seats or more (excluding the driver's seat) and carries 27 preschool children or primary school students, there must be at least 2 managers on each vehicle.

Managers and drivers are responsible for checking preschool children and primary school students when getting off the vehicle; children must not be left in the vehicle when the manager and driver have left the vehicle.

Drivers of cars transporting preschool children and students must have at least 2 years of experience driving passenger transport vehicles...
