Early warning to protect exports

Vietnamese exports are facing new pressures on trade defense as the investigated products are very diverse, from traditional products to products that have rarely or never been investigated, plus an increasing number of developing countries and new markets such as Egypt, Brazil... places that previously rarely investigated trade defense with Vietnam.

Therefore, in order to enhance competitiveness and perfect the supply chain, the Ministry of Industry and Trade continues to promote early warning of foreign trade defense cases against exported goods to adapt to global rules of the game.

Experts say that trade protection policies applied by countries are becoming increasingly diverse and complex. Many of Vietnam’s major trading partners, especially the United States and the European Union (EU), have continuously set up new standards and regulations related to imported products, and many other markets have also increased their investigations into the application of trade defense measures.

Statistics from the Trade Defense Department (Ministry of Industry and Trade) show that: In the first 5 months of 2025, Vietnamese export goods faced 9 new trade defense investigations initiated from 8 different markets; of which, 7 were anti-dumping investigations and 2 were safeguard investigations. At the same time, the Trade Defense Department is also handling 33 other cases arising from 2024 and many trade defense tax reviews. In addition, a number of export items have been submitted for investigation but have not been officially initiated.

The investigated products are very diverse, from traditional products such as steel, cement, fiber to products that have rarely or never been investigated such as corrugated paper, hard capsule shells, semi-trailers... Notably, there are more and more developing countries and new markets such as South Africa, Egypt, Brazil... places that previously rarely investigated trade defense with Vietnam.

According to the Trade Defense Department, the trend of investigations is not only increasing in quantity but also becoming more complex. Many countries such as Canada have included market economy issues in their investigations, while Mexico and Brazil have also begun to apply the method of using surrogate values from third countries to calculate anti-dumping margins. This causes the tax rate applied to Vietnamese goods to be often higher than the actual level and does not accurately reflect the production and business activities of enterprises.

Mr. Nguyen Hoai Nam - Deputy General Secretary of the Vietnam Association of Seafood Exporters and Producers (VASEP) said that the Association and enterprises have always received active support from the Trade Defense Department in the process of participating in anti-dumping and anti-subsidy lawsuits, thereby contributing to helping seafood enterprises improve their competitiveness in exports and maintain market share.

To continue maintaining the export activities of enterprises, Mr. Nguyen Hoai Nam recommended that the Trade Defense Department continue to increase early warnings about the risk of investigation to help enterprises prepare well to overcome the lawsuit and achieve positive results.

Deputy Minister of Industry and Trade Nguyen Sinh Nhat Tan said: In 2025, import and export will face many pressures and not only unpredictable fluctuations but also abnormalities. Therefore, many issues must be strived for with specific indicators, especially import and export to set a breakthrough growth target. Therefore, it is necessary to promote early warning in the direction of information stratification, otherwise it will not meet the expectations of businesses and industry associations. At the same time, avoid forecasting without the same criteria as businesses and associations, leading to lack of synchronization in implementation.

In order to support businesses and industries to proactively respond to the risk of being investigated by foreign countries, Mr. Chu Thang Trung, Deputy Director of the Department of Trade Defense, emphasized that an early warning system has been established and operated to monitor, collect, and analyze data related to Vietnamese export products at risk of being subject to trade defense measures.

Currently, the system focuses on analyzing information from various sources, including export data and information from more than 60 Vietnamese trade deals in major international markets. Thereby, it helps to identify early signs of trade conflicts or risks of trade defense investigations such as anti-dumping, anti-subsidy or self-defense.

In particular, the system is closely monitoring hundreds of Vietnamese export items to key markets such as the United States, the EU, Canada, India, Australia and several Southeast Asian countries. Through the analysis process, nearly 300 high-risk export items have been identified and placed on the warning list.

According to Mr. Chu Thang Trung, in order to support businesses and improve early warning capabilities, the Trade Defense Department will increase the organization of training programs and specialized seminars suitable for each industry and locality to ensure practicality and effectiveness. Furthermore, it will continue to maintain and develop the early warning system through the collection and analysis of export data and information related to trade defense from international markets. The list of items at risk of investigation will be updated regularly so that businesses can proactively adjust their production and export strategies.

On the other hand, the Department will closely coordinate with industry associations and businesses to provide detailed information on regulations, principles and procedures for trade defense investigations. At the same time, it will support businesses in preparing necessary documents and evidence to protect their rights in the investigation case. In addition, it will closely monitor the investigation activities of foreign trade defense agencies to ensure compliance with international commitments and legal regulations. The Department of Trade Defense will proactively discuss and intervene when detecting any unreasonable points that are disadvantageous to Vietnamese businesses.

In particular, the Department will promote communication through electronic newsletters, specialized publications and articles in the media. At the same time, it will organize training courses on regulations on origin of goods, prevention of commercial fraud and illegal transshipment to support businesses in complying with international regulations.

“The Trade Defense Department will continue to coordinate with relevant ministries and sectors to develop policies and implement support measures to protect the interests of domestic manufacturing industries. At the same time, it will create favorable conditions for businesses to expand export markets in the context of increasing pressure from trade defense measures,” Mr. Chu Thang Trung stated.
