Instead of the basic salary, a reference level appears to calculate social insurance benefits.

The draft revised Law on Social Insurance has been accepted and revised to include a reference level.

According to the draft Law, the reference level is the amount of money prescribed by the Government used to calculate the contribution and benefit levels of some social insurance regimes.

The reference level is adjusted based on the increase in the consumer price index, economic growth and in accordance with the capacity of the state budget and social insurance fund.

Compared to the current law, the draft revised Law on Social Insurance has replaced the basic salary with a reference level to calculate contributions and enjoy some social insurance regimes.

Specifically, regarding the basis for social insurance contributions, the draft Law stipulates that the salary used as the basis for compulsory social insurance contributions is at least equal to the reference level and at most 20 times the reference level at the time of contribution in the cases as prescribed.

The income used as the basis for voluntary social insurance contributions of the subjects is determined to be at least equal to the poverty line for rural areas and at most 20 times the reference level applied at the time of payment.

Compared to the draft revised Law on Social Insurance submitted at the 6th session, the reference level has replaced the basis for contribution based on the monthly minimum wage. Compared to the current law, the reference level has replaced the basic wage.

In addition, the draft Law also states that the level of health care and recovery benefits after illness per day is equal to 30% of the reference level, replacing the amount of VND 540,000 stated in the draft revised Law on Social Insurance submitted to the 6th session.

In addition, the one-time subsidy for each child, the level of health care and recovery benefits after maternity leave, the funeral subsidy, and the monthly death benefit for each relative are all regulated according to the reference level.

According to the provisions of the Law on Social Insurance 2014, social insurance benefits are currently calculated based on the basic salary level such as: The level of health care and recovery benefits after illness for one day is equal to 30% of the basic salary; the level of one-time benefits when giving birth or adopting a child.

The level of benefit for recuperation and health recovery after maternity leave is equal to 30% of the basic salary per day; the funeral allowance is equal to 10 times the basic salary.

The monthly death benefit for each relative is 50% of the basic salary. In case the relative has no direct caregiver, the monthly death benefit is 70% of the basic salary.
