The Circular consists of 3 chapters and 8 articles, effective from July 1, 2025.
Circular 02 guides the implementation of a number of regulations in the field of State management of the Government Inspectorate related to local authorities at two levels on the organization of citizen reception, settlement of complaints and denunciations at the commune level, information and reporting regime of the People's Committee at the commune level on citizen reception, settlement of complaints and denunciations and prevention and combat of corruption.
This Circular applies to the People's Committees of provinces and centrally run cities (hereinafter referred to as provincial-level People's Committees), specialized agencies under provincial-level People's Committees and equivalent (hereinafter referred to as specialized agencies under provincial-level People's Committees); People's Committees of communes, wards, and special zones under provincial level (hereinafter referred to as commune-level People's Committees), specialized agencies under commune-level People's Committees; relevant agencies, organizations and individuals.

Responsibilities of the Chairman of the Provincial People's Committee, the Chairman of the Commune People's Committee and relevant agencies
Article 2 of Circular 02 on the responsibilities of the Chairman of the Provincial People's Committee, the Chairman of the Commune People's Committee and relevant agencies in receiving citizens, handling complaints and denunciations and preventing and combating corruption.
Accordingly, the Chairman of the Provincial People's Committee is responsible for directing the implementation of citizen reception, complaint and denunciation settlement and corruption prevention and control within the province's management area; reviewing, resolving and removing difficulties and obstacles in performing the tasks of citizen reception, complaint and denunciation settlement and corruption prevention and control at the request of the Chairman of the Commune People's Committee.
The Inspectorate of provinces and centrally-run cities (hereinafter referred to as the Provincial Inspectorate) is responsible for guiding, monitoring and urging the People's Committees at the commune level in performing the work of receiving citizens, handling complaints and denunciations and preventing and combating corruption.
Specialized agencies under the provincial People's Committee, within the scope of their functions, tasks and powers, are responsible for coordinating with the commune-level People's Committees in receiving citizens, handling complaints and denunciations, and preventing and combating corruption.
The Chairman of the People's Committee at the commune level directs and organizes the implementation of citizen reception, complaint and denunciation settlement and corruption prevention and control in the commune-level management area; reports to the People's Committee at the provincial level and the Provincial Inspectorate on the results of the implementation of citizen reception, complaint and denunciation settlement and corruption prevention and control tasks according to regulations.
Instructions for implementing some regulations on receiving citizens, handling complaints and denunciations
According to Article 3 of Circular 02 on organizing the implementation of citizen reception tasks at the commune level, the Chairman of the People's Committee at the commune level is responsible for directing and organizing the implementation of citizen reception work at the commune level according to the provisions of Article 3 of Decree No. 141/2025/ND-CP dated June 12, 2025 of the Government regulating the division of authority of two-level local authorities in the field of State management of the Government Inspectorate and provisions of relevant laws.
The Office of the People's Council and People's Committee at the commune level is responsible for assisting the Chairman of the People's Committee at the commune level in performing a number of tasks, including: Assigning people to regularly receive citizens at the headquarters of the People's Committee at the commune level; advising the Chairman of the People's Committee at the commune level in performing the task of receiving citizens periodically and suddenly according to regulations; receiving, classifying and handling complaints, denunciations, recommendations and reflections according to regulations; summarizing the situation and results of receiving citizens and handling petitions at the commune level; periodically and suddenly reporting to competent agencies and organizations.
The Office of the People's Council and the People's Committee at the commune level advises the Chairman of the People's Committee at the commune level in coordinating with the Office of the Party Committee, the Inspection Committee of the Party Committee at the commune level and relevant agencies and organizations to receive citizens at the headquarters of the People's Committee at the commune level.
In case of a crowded, complicated incident that may affect security and order in the area, the Office of the People's Council and the People's Committee at the commune level shall advise the Chairman of the People's Committee at the commune level to promptly report to the Chairman of the People's Committee at the provincial level for direction on handling.
The Chairman of the Provincial People's Committee directs the Provincial Inspectorate, the Provincial Citizen Reception Committee and relevant agencies to guide and coordinate with the Commune People's Committee to promptly handle the matter.
Complaint resolution at commune level
Regarding complaint settlement at the commune level, Article 4 of Circular 02 guides that the Office of the People's Council and the People's Committee at the commune level shall advise the Chairman of the People's Committee at the commune level to assign a specialized agency to consider accepting the complaint; in cases where the conditions for acceptance are met, the Chairman of the People's Committee at the commune level shall issue a notice of acceptance; in cases where the conditions for acceptance are not met, the complainant shall be notified of non-acceptance and the reasons shall be clearly stated.
The specialized agency assigned to conduct verification or advise the Chairman of the Commune People's Committee to establish a verification team to verify the complaint content; report the verification results, advise the Chairman of the Commune People's Committee to consider and issue a decision to resolve the complaint according to regulations.
The Office of the People's Council and People's Committee at the commune level advises the Chairman of the People's Committee at the commune level in monitoring, urging and organizing the implementation of the complaint settlement decision of the Chairman of the People's Committee at the commune level with legal effect.
In case the complainant does not agree with the decision to resolve the complaint of the Chairman of the Commune People's Committee and appeals to the Chairman of the Provincial People's Committee, the Chairman of the Provincial People's Committee shall consider and resolve the complaint a second time according to the provisions of law.
Resolving complaints at the commune level
Regarding the settlement of denunciations at the commune level, Article 5 of Circular 02 guides that the Chairman of the People's Committee at the commune level himself or assigns a specialized agency under the People's Committee at the commune level to initially handle the denunciation information, check and verify information about the denouncer, conditions for accepting the denunciation and advise the Chairman of the People's Committee at the commune level to consider accepting the denunciation.
In case the conditions for accepting the complaint are met, the Chairman of the Commune People's Committee shall issue a decision to accept the complaint and assign a specialized agency under the Commune People's Committee to verify the content of the complaint. In case the conditions for accepting the complaint are not met, the Chairman of the Commune People's Committee shall not accept the complaint and shall notify the complainant of the reason.
The assigned professional agency shall verify the content of the denunciation or advise the Chairman of the Commune People's Committee to establish a verification team to verify the content of the denunciation; report the verification results and advise the Chairman of the Commune People's Committee to consider and issue a conclusion on the content of the denunciation.
The Chairman of the People's Committee at the commune level decides to handle the violation according to his/her authority or recommends handling the violation according to the conclusion of the denunciation; notifies the denouncer of the conclusion of the denunciation; directs the monitoring and urging of the implementation of the conclusion of the denunciation and the decision to handle the denounced violation.
