Provincial level is responsible for complex and large-scale procedures.
From July 1, the administrative system in the land sector will officially operate under a new decentralized model.
The Ministry of Agriculture and Environment has just issued Decision 2304/QD-BNNMT promulgating administrative procedures in the land sector under the state management scope of the Ministry.
Of which, the administrative procedures that have been amended, supplemented, and replaced are under the management scope of the Ministry of Agriculture and Environment, including 48 procedures: 2 central-level administrative procedures; 32 provincial-level procedures; and 14 commune-level procedures.
Accordingly, 32 procedures are decentralized to the provincial level, mainly complicated procedures related to land use rights of organizations, investment projects or have specific legal factors.
A series of procedures related to land change registration are carried out at the provincial level such as: individuals using land to establish private enterprises; transferring, inheriting, contributing capital, leasing or handling assets attached to land in civil and commercial transactions; changing land user information; changing land use purposes without permission; handling the results of judgments, enforcement decisions or land disputes.
In the field of granting land use right certificates (LURCs), the provincial level implements many special cases such as: granting LURCs for land plots with increased area due to boundary adjustment; exchanging or re-granting lost LURCs; revoking incorrectly granted LURCs; granting LURCs to transferees who have not completed procedures before August 1, 2024; or granting LURCs for cases of land use for improper purposes before 2014.
In addition, the provincial level is also responsible for procedures on land allocation, land lease, and land use conversion, especially in projects that do not go through auctions or have large investment scales. The authority to adjust decisions related to errors in boundaries, areas, or allocation of sea areas for sea encroachment also belongs to the provincial level.
The functions of land division/merger, initial land registration, dispute resolution, provision of land data, cancellation of land use fee debt and registration of assets attached to land in real estate projects... are also performed at the provincial level to ensure consistency and high accuracy in management.

Commune level proactively handles 14 procedures close to people and practical
Along with decentralization to the provincial level, the Ministry of Agriculture and Environment also decentralizes 14 land administrative procedures to the commune level, aiming to shorten the processing time for routine tasks that are close to the people.
Of which, there are 5 procedures related to registration and issuance of certificates, including: Re-determining the area of residential land that was granted a certificate before July 1, 2004; correcting erroneous certificates; revoking and re-issuing erroneously granted certificates; registering and issuing certificates for the first time to organizations using land; issuing certificates to households, individuals, residential communities or people of Vietnamese origin residing abroad.
Regarding land allocation, land lease, and land use purpose conversion, the commune level carries out 5 procedures including: land allocation, land lease without auction; change of land allocation/lease form; adjustment of land allocation and land lease decisions when there are changes in legal basis or boundaries, area; and land allocation without auction for a number of priority groups such as civil servants, teachers, medical staff in difficult areas, and permanent residents in the commune who do not have land for residence.
Notably, the remaining four procedures clearly demonstrate a role close to the people, such as: donating land use rights to the State or the community; using land for multiple purposes; resolving land disputes under the authority of the Chairman of the Commune People's Committee; and organizing land dispute mediation at the grassroots level.
The administrative procedures announced in this Decision are stipulated in Decree No. 151/2025/ND-CP regulating the delimitation of authority of local authorities at 02 levels, decentralization, and decentralization in the field of land; Decree No. 131/2025/ND-CP regulating the delimitation of authority of local authorities at 02 levels in the field of state management of the Ministry of Agriculture and Environment; Decree No. 118/2025/ND-CP regulating the implementation of administrative procedures under the one-stop, one-stop mechanism at the One-stop Department and the National Public Service Portal.
