In which, defendant Nguyen Van Hau was prosecuted by the Supreme People's Procuracy for the crimes of "Violating accounting regulations causing serious consequences" (according to the provisions of Article 221, Clause 3 - Penal Code), "Violating bidding regulations causing serious consequences" (according to the provisions of Article 222, Clause 3 - Penal Code) and the crime of "Giving bribes" (according to the provisions of Article 364, Clause 4 - Penal Code).
9 defendants: Hoang Thi Thuy Lan, Le Duy Thanh, Nguyen Van Khuoc, Hoang Van Nhiem, Chu Quoc Hai, Cao Khoa, Le Viet Chu, Dang Van Minh, Pham Hoang Anh were prosecuted for the crime of "Receiving bribes" under the provisions of Article 354, Clause 4 of the Penal Code.
Eight defendants: Pham Van Vong, Phung Quang Hung, Ha Hoa Binh, Ngo Duc Vuong, Nguyen Doan Khanh, Dinh Thi Thu Huong, Cao Dai Nghia, Nguyen Ngoc Huy were prosecuted for the crime of "Abusing position and power while performing official duties" as prescribed in Article 356, Clause 3 of the Penal Code.
17 defendants including: Pham Ngoc Cuong, Do Huu Vinh, Phan Van Vi, Do Ngoc Hoa, Nguyen Minh An, Bui Minh Hong, Hoang Quoc Tri, Khong Van Thuyet, Dam Huu Tuan, Nguyen Xuan Nham, Nguyen Tien Khoi, Luu Quang Huy, Le Duc Tho, Tran Xuan Nghia, Ha Hoang Viet Phuong, Le Quoc Dat, Pham Ngoc Thuy were prosecuted for the crime of "Violating bidding regulations causing serious consequences" according to the provisions of Article 222, Clause 3 of the Penal Code.
5 defendants: Nguyen Thi Hang, Do Thi Mai, Hoang Thi Tuyet Hanh, Nguyen Hong Son, Tran Huu Dinh were prosecuted for the crime of "Violating accounting regulations causing serious consequences" according to the provisions of Article 221, Clause 3 of the Penal Code.
Defendant Dang Trung Hoanh was prosecuted for the crime of "Taking advantage of influence over people in positions of power for personal gain" under the provisions of Article 366, Clause 3 of the Penal Code.
According to the indictment of the Supreme People's Procuracy, during the implementation of projects and bidding packages in Vinh Phuc, Quang Ngai and Phu Tho provinces, including: 4 projects and 4 bidding packages in Vinh Tuong district, Vinh Phuc province; 2 bidding packages in Quang Ngai province; 4 bidding packages belonging to 2 projects at Hung Temple historical relic site, Phu Tho province and a number of other projects, Nguyen Van Hau (Chairman of the Board of Directors, General Director of Phuc Son Group, Chairman of the Board of Directors of Thang Long Company) directly implemented, directed subordinates or colluded with other units to commit acts violating the provisions of the law on bidding and accounting.
The violations of Nguyen Van Hau and his accomplices and related subjects in the case have caused particularly serious damage to the State, with a total amount of 1,168 billion VND. Of which, the damage from violating accounting regulations is more than 504 billion VND, from redetermination of land prices is 204 billion VND and from violating bidding regulations is nearly 460 billion VND. Hau's violations also led to a series of officials in the above localities being criminally prosecuted, disciplined, reducing people's trust and causing public outrage.
In addition, Nguyen Van Hau also took advantage of relationships, used money and material benefits to connect and collude with individuals holding positions and powers in state management agencies in the above localities or in consulting units, so that these individuals could commit illegal acts at Hau's request and suggestion, creating conditions for companies in the Phuc Son ecosystem to win bids, implement projects and packages, illegally benefit, causing serious damage to state assets. Through the activities of social security work and land purchase in Mang Thit district, Vinh Long province of Phuc Son Group, some subjects took advantage of their influence on people holding positions and powers for personal gain.
