Perfecting the legal framework on intellectual property
In his opening speech, Associate Professor, Dr. Tran Viet Dung, Vice Rector of Ho Chi Minh City University of Law, said that the Conference is an important scientific event, taking place in the context of Vietnam gradually affirming its new position in the international arena, when the knowledge-based economy, innovation and digital transformation have become the central driving forces for sustainable growth. In particular, the new Resolutions of the Politburo and the National Assembly have once again clearly affirmed the key role of innovation and intellectual property law in the transformation of the nation.
In addition, after nearly 20 years of implementation, the Intellectual Property Law has demonstrated its key role in the Vietnamese legal system on science and technology. However, practical implementation has also revealed many urgent issues that require amendment, supplementation and improvement. This becomes even more urgent when we face new requirements from Resolution No. 57-NQ/TW dated December 22, 2024 of the Politburo and Resolution No. 193/2025/QH15 of the National Assembly.
With the spirit and clear direction from these Resolutions, the Workshop will be a prestigious academic forum where experts, scientists, managers and related subjects discuss specific pilot mechanisms and policies and propose recommendations and solutions to perfect the legal framework on intellectual property.

At the workshop, Dr. Nguyen Phan Khoi - Faculty of Law, Can Tho University and Dr. Vo Nguyen Hoang Phuc - Institute of Intellectual Property, Entrepreneurship and Innovation, Ho Chi Minh City University of Law presented papers promoting scientific research and technology transfer, emphasizing that scientific research and technology transfer have a mutual relationship, playing an important driving force in promoting socio -economic development. The two analyzed the legal aspects of research and technology transfer contracts, paying special attention to the provisions on the division of benefits and risks between the participating parties, especially from the perspective of the State - with the role of both a research investor and a technology transfer recipient.
Dr. Nguyen Phan Khoi and Dr. Vo Nguyen Hoang Phuc also pointed out the role of contract terms in promoting research and technology transfer activities, thereby proposing solutions to improve the legal framework and improve application efficiency. In addition, the presentation also emphasized the need to develop flexible contract terms, balancing benefits and risks in a reasonable manner, not only promoting research and technology transfer activities but also contributing to the larger goal of developing science and technology and innovation.
Promoting spin-off business activities
Referring to the BK Holdings model (Hanoi University of Science and Technology) and lessons learned for establishing and operating spin-off businesses (understood as creating a new company or business unit from an existing organization) to perfect the legal framework for spin-off business models in Vietnam, another group of authors analyzed the current legal basis and proposed necessary changes to promote spin-off activities in Vietnam.
Dr. Hua Thuy Trang, Director of Business Cooperation, BK Holdings Company - Hanoi University of Science and Technology, said that the spin-off business model in higher education institutions is a strategic solution to promote knowledge transfer, commercialize research results and develop the national innovation ecosystem.

According to the authors, Vietnam has taken positive policy steps through Resolution 57-NQ/TW, Resolution 193/2025/QH15 and accompanying guiding documents. However, for this model to be truly effective, it needs a synchronous, specific, feasible legal corridor, accompanied by a reasonable incentive and risk protection mechanism. With practical lessons from BK Holdings, the delegates concluded that to promote the development of spin-off enterprises of universities in particular and the innovative startup ecosystem of Vietnam in general, it is necessary for the "three houses" in the innovative startup ecosystem - the state, schools and businesses - to join hands, cooperate and develop sustainably.
In addition, at the Workshop, delegates also discussed issues related to new, prominent issues and challenges to intellectual property law such as AI and intellectual property rights, protection of non-traditional industrial designs, protection of national names... From there, delegates proposed and recommended to improve intellectual property law to improve the effectiveness of commercialization of intellectual property rights in particular and create a legal basis for the protection of intellectual property rights in general, serving socio-economic development in the era of national development.
