According to the Department of Agriculture and Environment, Decree No. 151 will officially take effect from July 1, 2025. In particular, implementing decentralization and delegation of authority, many tasks in the process of land recovery, compensation, support and resettlement will be decentralized and delegated to the People's Committee at the commune level, the Chairman of the People's Committee of the commune such as: directing and organizing the implementation of compensation, support and resettlement tasks prescribed in Clause 1 and Clause 3, Article 86, Land Law; organizing the enforcement of land recovery decisions, resolving complaints related to enforcement according to the provisions of law on complaints; ensuring necessary conditions and means for enforcement, arranging funds for land recovery enforcement prescribed in Point a, Clause 5, Article 89, Land Law; organizing the establishment and implementation of resettlement projects prescribed in Clause 6, Article 91 and Clause 1, Article 110, Land Law, etc.
Therefore, the province needs to develop a set of procedures and coordination mechanisms between the People's Committees at the commune level and the Provincial and Regional Land Fund Development Centers to implement the tasks of compensation, support and resettlement. At the same time, the Department of Agriculture and Environment proposed to establish a team to draft procedures and regulations for coordination.
Speaking at the meeting, Vice Chairman of the Provincial People's Committee Ho Van Ha emphasized that to successfully achieve double-digit growth, speeding up project progress is very important.
Therefore, site clearance is identified as a key and important task. Site clearance must be one step ahead. Vice Chairman of the Provincial People's Committee Ho Van Ha agreed to establish a team to compile a set of procedures and regulations to coordinate the implementation of compensation, support and resettlement tasks in the province.
The Provincial Land Fund Development Center is the unit in charge of implementation. By June 30, the draft must be completed and submitted to the Department of Justice for appraisal so that on July 1, it can be submitted to the Provincial People's Committee to collect opinions from departments, branches and 95 wards and communes in the province.
Vice Chairman of the Provincial People's Committee Ho Van Ha also noted that the drafting process must ensure decentralization and delegation of authority, follow a simplified process and must clearly indicate "people, work, and tasks".
