Subjects eligible to rent social housing invested in and built by the National Housing Fund include subjects entitled to social housing support policies prescribed in the law on housing.
The Ministry of Construction is drafting a Decree regulating the National Housing Fund. In the draft, the Ministry has proposed regulations on the Fund's investment and housing creation activities for rent.
Principles of investment and housing creation
According to the draft, the Fund shall invest in the construction of independent social housing projects for each project with a term of no more than 05 years; and investment projects in the construction of social housing with synchronous technical infrastructure and social infrastructure for rent for each project with a term of no more than 07 years.
The Fund's investment and housing creation must be consistent with the Fund's operational objectives and it shall only be responsible for the Fund's debts and other financial obligations within the scope of the invested capital.
Investment and creation of housing shall be carried out in accordance with the provisions of this Decree and relevant legal provisions.
For the service and commercial business area in the social housing construction investment project directly invested in or created by the Fund, management and business shall be carried out in accordance with the provisions of the law on real estate business.
Forms and procedures of investment of the Fund
The draft clearly states the Fund's investment form as follows:
a) Directly invest in the construction of unique social housing projects, social housing construction investment projects with synchronous technical infrastructure and social infrastructure systems;
b) Directly invest in repairing and renovating houses belonging to public assets that are received and have their functions converted according to the provisions of the law on housing;
c) Directly purchase social housing from project investors who invest in building social housing for rent according to the ordering mechanism or purchase agreement contract;
d) Directly purchase commercial housing under the market mechanism for lease to officials, civil servants, public employees, and workers of state agencies, political organizations, socio -political organizations, and central public service units;
d) Repair and renovate houses belonging to public assets that are received and have their functions converted according to the provisions of the law on housing.
The draft clearly states that the procedures for investing in the construction of social housing, investing in the repair and renovation of public housing as prescribed in Point a and Point b above using capital from the national housing fund shall be implemented in accordance with the provisions of the law on public investment.
Procedures for purchasing social housing and commercial housing as prescribed in Points c and d above for rent are as follows:
Before purchasing social housing or commercial housing to arrange for tenants, the Fund must establish a project to purchase social housing or commercial housing. The Minister of Construction or the Chairman of the Provincial People's Committee shall decide on the investment policy to purchase social housing or commercial housing.
The main contents of the social housing and commercial housing purchase project include: location, site, type of house, number of houses, usable area of each type of house, house purchase price, related costs, capital source for house purchase, method of payment for house purchase, agency signing the house purchase contract, project implementation progress, agency responsible for managing the house after purchase, responsibilities of relevant agencies in project implementation.
The purchase price of social housing and commercial housing is decided by the investor based on the housing selling price of the investor, referring to the housing buying and selling price on the market and the price appraisal results of the unit with price appraisal function at the time of housing purchase.
Housing operation and rental management
According to the draft, the subjects eligible to rent social housing built and created by the Investment Fund include those who are entitled to social housing support policies prescribed in the law on housing.
Subjects eligible to rent housing built and created by the Investment Fund include cadres, civil servants, public employees, and workers.
Rental price, housing rental procedure
The rental price of housing constructed and created by the Investment Fund is implemented as in the case of determining the rental price of social housing invested and built by the State using public investment capital and trade union financial resources according to the provisions of the law on housing.
The procedure for renting housing built and created by the Investment Fund is the same as the case of renting social housing built and invested by the State with public investment capital according to the provisions of the law on housing.
Housing operations management
The Fund shall establish a affiliated unit to manage and operate housing or hire a qualified housing management and operation unit to manage and operate housing in accordance with the provisions of the law on housing.
In case of hiring a housing management and operation unit, a bidding must be organized to select a unit to perform management and operation according to the provisions of the law on bidding.
The fund calculates the cost of housing management and operation into the housing rental price.
The Fund decides on the use of funds collected from business activities of the service and commercial business area in social housing construction investment projects directly invested in or created by the Fund to support maintenance costs and housing management and operation.
The Ministry of Construction is soliciting comments on this draft on the Ministry's Electronic Information Portal.
