Evaluation of processing results in fisheries exploitation in Nghe An

On the morning of June 20, the Inspection Team for law enforcement on handling administrative violations in the field of fisheries had a working session with Nghe An province.

Attending the meeting, on behalf of the Ministry of Justice delegation, there was Mr. Ho Quang Huy - Department of Document Inspection and Administrative Violation Handling Management, Ministry of Justice as head of the delegation. Also participating were representatives of the Department of Fisheries Control; Ministry of Agriculture and Environment.

On the side of Nghe An province, there were comrades: Nguyen Van De - Member of the Provincial Party Executive Committee, Vice Chairman of the Provincial People's Committee; Ho Quyet Thang - Deputy Commander of the Provincial Border Guard Command; Representatives of relevant units, departments, branches and localities.

Implement violations handling in a methodical and procedural manner

The representative of the Ministry of Justice said that the delegation's working session in Nghe An, in addition to grasping the practical situation of implementing control and handling of administrative violations in fisheries exploitation in the province, also aimed to exchange and receive feedback and recommendations from localities in handling administrative violations as well as other tasks, moving towards removing the IUU yellow card with the whole country.

The inspection team conducted a total of 35 inspections. Records of administrative sanctions for violations in the fisheries sector related to IUU issued between January 1, 2024 and March 15, 2025 (according to the list of records numbered in order by the inspected agency), of which 21 records were decided by competent officials of agencies and units of the Provincial People's Committee and 14 The records are decided by competent officials of agencies and units of the Provincial Border Guard Command.

Based on the results of the work and reports on the enforcement of the law on handling administrative violations, the Ministry of Justice has concluded the preliminary results of the inspection of the enforcement of the law on handling administrative violations in the field of fisheries at the People's Committee and the Border Guard Command of Nghe An province.

The inspection process shows that the enforcement of the law on handling administrative violations in the field of fisheries has been paid attention to, directed, and resolutely implemented by the leaders of the Provincial People's Committee and the Border Guard Command of Nghe An Province and has achieved certain results. The direction and operation work has been focused on; the inspection and examination work has been strengthened and carried out regularly.

The Provincial People's Committee and the Provincial Border Guard Command have directed departments, branches, localities, and units to participate in drafting and commenting on legal documents at the request of competent authorities.

In particular, the Department of Agriculture and Environment directed the Department of Fisheries and Fisheries Control to coordinate with the Provincial Border Guard Command, the Provincial Police, and local authorities to conduct 22 patrols, inspections, and controls at estuaries and at sea. The Border Guard Command directed units to develop plans and approve 42 monthly patrol and control plans at sea; issue inspection plans, urge, guide the investigation, verification, and advise on handling of fishing vessels that lose connection to VMS equipment at sea, and fishing vessels that violate foreign waters.

The Coast Guard Force has conducted 566 patrols, inspections, and controls at river mouths, estuaries, boat moorings, and at sea.

Dissemination, legal education, guidance, training, and professional development on handling administrative violations in the fisheries sector continue to receive attention. The handling of administrative violations, especially by the Border Guard, is carried out methodically, in accordance with procedures.

Continue to overcome the problems

However, in reality, the coordination between local authorities and functional forces is sometimes not timely, especially in coordinating to verify and clarify cases with signs of violations of disconnection and exceeding the boundaries of permitted exploitation areas at sea.

The process of handling violations still faces many difficulties and obstacles. At the meeting, the delegates expressed their opinions on the results as well as the current situation, difficulties and obstacles in the implementation process. For example, difficulties in detecting and handling violations of lost connection of VMS positioning devices on fishing vessels due to service providers; related to regulations on handling and enforcing sanctioning documents under the authority of units, departments, branches, etc.

Comrade Nguyen Van De - Vice Chairman of the Provincial People's Committee acknowledged and accepted the assessments and instructions of the working group. He also affirmed that the Provincial People's Committee will continue to direct departments, branches and units to properly implement regulations. Continue to direct and strengthen close coordination between the Border Guard force and departments and branches to ensure work efficiency.

The Vice Chairman of Nghe An Provincial People's Committee also hopes that the Ministry of Justice will provide further guidance for the documents and minutes that are not yet complete. Strengthen training on administrative procedures for localities to help localities and the whole country soon achieve the goal of removing the IUU yellow card.

The inspection team also confirmed that it acknowledged the recommendations of the leaders of the Provincial People's Committee, the Border Guard Command of Nghe An province and relevant agencies on the working results to recommend competent authorities to resolve.
