This is one of the notable contents in Decree 172/2025 of the Government regulating the handling and disciplining of cadres and civil servants; effective from July 1.
The Government said that after the Law on Organization of Local Government took effect, local government was transferred from 3 levels to 2 levels, so some current regulations on disciplinary actions related to district and commune levels were no longer appropriate.
Therefore, the process of implementing regulations on disciplinary action against cadres, civil servants and public employees has arisen with some problems that need to be revised to ensure consistency.
The Decree supplements specific provisions on violations that are considered for mitigating or increasing the level of discipline.
In case of violation with one or more of the following circumstances, the disciplinary level will be reduced:
Proactively report violations, voluntarily accept personal responsibility for shortcomings and violations, and accept disciplinary action commensurate with the content, nature, and severity of the violation before and during the inspection and supervision process.
Proactively provide information, records, documents, and fully and honestly reflect on fellow violators.
Proactively stop violations, actively participate in preventing violations; voluntarily hand over corrupt assets, compensate for damages, and remedy the consequences caused by oneself.
In case of violation with one or more of the following circumstances, the disciplinary level will be increased:
Having been requested by an agency, organization or unit to review but not implementing, not correcting shortcomings and violations. Not voluntarily admitting shortcomings and violations, the form of discipline is commensurate with the content, nature and level of the violation; causing material damage that must be compensated but not compensated, not remedying the consequences or remedying not in accordance with the requirements of the competent authority, not voluntarily returning money and property resulting from the violation.
Dealing with, circumventing, obstructing the process of inspection, supervision, examination, auditing, investigation, prosecution, trial, and execution of judgment. Covering up for violators; threatening, repressing, and taking revenge on those who fight, denounce, testify, or provide documents and evidence of violations.
Organized violations, being the mastermind; providing false information and reports; preventing others from providing evidence of violations; concealing, modifying, destroying evidence, creating fake documents, records, and evidence.
Taking advantage of one's position, power, taking advantage of a state of emergency, natural disaster, fire, or epidemic to implement social security, national defense, and security policies for personal gain. Forcing, mobilizing, organizing, or assisting others in committing violations.
The Government also stipulates that the statute of limitations for disciplinary action is the period after which cadres, civil servants, and retired or resigned persons who commit violations will not be subject to disciplinary action.
The statute of limitations for disciplinary action is calculated from the time of the violation until the time the competent authority issues a written notice of consideration for disciplinary action.
In case there is a new violation within the time limit for calculating the statute of limitations for disciplinary action as prescribed, the statute of limitations for disciplinary action for the old violation shall be recalculated from the time the new violation occurs.
The time limit for disciplinary action against officials and civil servants is the period from the time of discovery of the violation of the official or civil servant until the decision on disciplinary action is made by the competent authority.
The disciplinary handling period shall not exceed 90 days; in cases where the case has complicated circumstances requiring further inspection and verification, the disciplinary handling period may be extended but shall not exceed 150 days.
