The Chairman of the Provincial People's Committee requested to promptly detect and report cases of using social housing for the wrong subjects.

Thanh Hoa Provincial People's Committee issued Official Dispatch No. 11576/UBND/CNXDKH dated July 21, 2025 on directing the rectification and completion of the purchase, sale, management and use of social housing in the province to overcome the shortcomings discovered through inspection.

According to the official dispatch of the Provincial People's Committee, in recent times, the development and management of social housing in the province has initially achieved positive results. The Provincial Party Committee, the Provincial People's Committee, and the Chairman of the Provincial People's Committee are resolutely directing the completion of social housing development targets according to the roadmap assigned in Decision No. 444/QD-TTg dated February 27, 2025 of the Prime Minister . Up to now, many social housing projects in the province have been started and implemented, and some projects have been completed and put into use, serving the housing needs of the people.

However, according to the report of the Department of Construction on the results of inspection of the purchase, sale and management of social housing, there are still some limitations and shortcomings such as: Delay in receiving documents; Incomplete disclosure and transparency of project information; There is a situation of using apartments for the wrong subjects or for the wrong purposes; Some management and operation units have not met the conditions according to regulations.

Therefore, the Chairman of the Provincial People's Committee requested investors to strictly follow the procedures for selling, leasing, and renting social housing in accordance with the provisions of Article 38 of Decree No. 100/2024/ND-CP dated July 26, 2024 of the Government , in which it is important to fully disclose project information, receive documents, sign sales, leasing, and leasing contracts in accordance with regulations and to the right subjects.

Investors need to review and thoroughly overcome shortcomings in the process of receiving registration dossiers; organize the reception of dossiers in many forms to ensure full reception, avoid backlogs, causing frustration among the people, while minimizing crowds, maintaining security and order in the reception area during peak periods.

Investors shall coordinate with the Apartment Building Management Board (if established) to fully hand over the apartment building documents, the maintenance fund for common property, and open an account to manage maintenance funds according to the provisions of Clause 6, Article 19 of the Regulations on management and use of apartment buildings issued together with Circular 05/2024/TT-BXD dated July 31, 2025 detailing a number of articles of the Housing Law.

At the same time, the investor coordinates with the People's Committees of communes, wards, local police and relevant units in monitoring and managing social housing users after handover; promptly detects, summarizes and reports cases of misuse, wrong purpose or signs of illegal transfer for timely handling in accordance with the provisions of law.

For the Management Board of the apartment building, it is necessary to receive the apartment building records and maintenance funds for the common property from the investor in accordance with the provisions of Circular No. 05/2024/TT-BXD. Promote propaganda and dissemination to apartment building users of the provisions of the law on social housing, especially the provisions related to the order and procedures for reselling social housing within 5 years according to Article 39 of Decree No. 100/2024/ND-CP, in order to raise awareness and prevent violations.

The apartment building management and operation unit shall review the conditions for implementing the management and operation of the apartment building according to the provisions of Clause 1, Article 84 of Decree No. 95/2024/ND-CP dated July 24, 2024 detailing a number of articles of the Housing Law; in case of non-compliance, it is necessary to promptly prepare a dossier requesting confirmation of conditions and send it to the Department of Construction or the Ministry of Construction for consideration and notification according to regulations.

The People's Committees of communes and wards must publicly disclose information related to social housing projects in the area as prescribed in Point a, Clause 1, Article 38 of Decree No. 100/2024/ND-CP, amended and supplemented in Clause 5, Article 14 of Decree 140/2025/ND-CP dated July 1, 2025. Proactively inspect and monitor the use and users of social housing in projects in the area, handle violations within their authority, report to the Provincial People's Committee on matters beyond their authority; guide the organization of the first Apartment Building Conference according to regulations; urge the establishment of the Management Board and the handover of documents and maintenance funds to ensure the management and operation of apartment buildings in accordance with regulations.

The Department of Construction is assigned to preside over, guide, urge and closely inspect the organization of receiving registration dossiers for purchasing, renting, and leasing-purchasing social housing at projects, ensuring implementation in many forms to ensure full and timely reception, avoiding missing dossiers, causing public outrage; at the same time, ensuring the legitimate rights of policy beneficiaries. Strengthen inspection, guidance and urging of relevant agencies and units in the implementation of purchasing, selling, managing and using social housing; promptly detect and handle violations within their authority or advise the Provincial People's Committee to consider and direct handling according to regulations.
