The Ministry of Industry and Trade is seeking comments on the Draft Decree on the management of multi-level marketing activities, replacing Decree No. 40/2018/ND-CP dated March 12, 2018, amended and supplemented by Decree No. 18/2023/ND-CP dated April 28, 2023 of the Government. The Draft is expected to complete the legal framework regulating the multi-level marketing sector, while meeting the requirements of administrative reform and facilitating businesses.
According to the Ministry of Industry and Trade, the development of the new Decree aims to update practical changes in the multi-level sales model, overcome shortcomings in the implementation of current regulations, especially the situation of taking advantage of the multi-level model to commit illegal acts, and attract people to participate in disguised forms. The draft focuses on amending and supplementing a series of regulations to improve transparency, professionalism and compliance with the law of businesses operating in this field.
An important pillar of the draft decree is the review and simplification of a series of administrative procedures in the field of multi-level marketing. This is a step in line with the administrative reform policy that is being strongly implemented by the Government , especially after Resolution No. 66/NQ-CP on the program of cutting and simplifying administrative procedures in 2025 was issued.

Accordingly, 11 administrative procedures are being proposed to be amended in the direction of reducing unnecessary steps, not incurring additional compliance costs for businesses. Procedures related to the issuance, extension, amendment, re-issuance or termination of multi-level sales registration certificates are proposed to be adjusted in the direction of streamlining, shortening processing time. Procedures on notification of activities, recognition of training programs, withdrawal of deposits, registration or change of activities at the local level... are also proposed to be amended in the same spirit.
Not only simplifying, the drafting agency also proposed to completely abolish two procedures: notification of changes in information on the list of goods traded under the multi-level marketing method and the procedure for checking and granting confirmation of legal knowledge on multi-level sales. This abolition aims to eliminate procedures that are no longer appropriate, contributing to reducing costs and reducing administrative burdens for legitimate businesses.
The development of the new Decree in the direction of both tightening management and creating favorable conditions for enterprises demonstrates the efforts of the Ministry of Industry and Trade in establishing a transparent business environment, healthy competition and in line with practical requirements. The draft also reflects the consistent viewpoint in current management, which is to link administrative reform with improving the effectiveness of state management, protecting consumer rights and preventing distorted business models.
