Responding to Tuoi Tre Online , the leader of the Department of Industry ( Ministry of Industry and Trade ) informed as above about the case of Nhat Minh Food Production and Import-Export Company Limited for Ofood cooking oil products, An Duong Trading and Service Company Limited, An Hung Phuoc Company Limited which were recently discovered and handled by Hung Yen Provincial Police for violations of "production and trading of counterfeit food, foodstuffs, food additives" and "smuggling".
Intentionally misrepresenting the nature of the product
According to the Department of Industry, vegetable oil used for animal feed is a raw material on the management list according to Circular 21, under the management of the Ministry of Agriculture and Environment . The production, trading and use of vegetable oil for this purpose must strictly comply with safety, quality, product declaration and labeling.
The act of using vegetable oil raw materials of animal feed origin to produce and process food for human consumption is an act of intentionally distorting the nature, uses and purposes of goods, showing signs of constituting the act of producing and trading in counterfeit goods.
Notably, the leader of this department said that vegetable oil used for animal husbandry does not meet food hygiene and safety standards and has no use or value for consumers.
When intentionally introduced into the human food production chain and labeled as "vegetable oil" or "cooking oil for humans", it is misleading in nature and use; there are signs of counterfeiting in terms of the use and purpose of the goods.
Regarding the responsibilities of management agencies, the Department of Industry said that according to the provisions of the Law on Food Safety, the Provincial People's Committee is responsible for local management; receiving self-declared products; certifying establishments that meet food safety conditions; inspecting, checking, and handling violations.
Through preliminary information, Nhat Minh Food Production and Import-Export Company Limited has self-declared its products for vegetable oil products.
However, the Ministry of Industry and Trade has not yet issued a certificate of food safety eligibility and has not yet received reports from local authorities and relevant agencies on the production and consumption of fake cooking oil.
The Ministry will increase large-scale inspections.
The Ministry of Industry and Trade said that in the coming time, it will step up market monitoring, inspection and control.
At the same time, "continue to direct the Department of Industry and Trade and coordinate with the People's Committees of provinces and cities to direct local functional units to conduct large-scale inspections of cooking oil production facilities". Especially small-scale facilities, facilities without food safety certificates, and facilities exempted from food safety certificates.
The Ministry of Industry and Trade said it also assigned the Department of Domestic Market Management and Development to preside over and coordinate with the Department of Industry and Trade to direct market management departments to closely monitor establishments producing, processing, and trading cooking oil products nationwide.
The above incident, according to the Ministry of Industry and Trade, shows signs of serious violations of the law on production and trade of counterfeit goods, commercial fraud, protection of consumer rights and violations of prohibitions under the law on food safety.
