Regarding the request to inspect the selection of contractors for the Ho Chi Minh City - Thu Dau Mot - Chon Thanh expressway project through Binh Phuoc province (now Dong Nai province) that Son Hai Group submitted a petition, Deputy Prime Minister Tran Hong Ha issued a document criticizing the Ministry of Finance .
Ministry of Finance is irresponsible
According to the document, the Ministry of Finance not only reported "very slowly" but also failed to properly implement the directive requirements related to this incident.
Specifically, Deputy Prime Minister Tran Hong Ha criticized the Ministry of Finance for being too slow in reporting. "The deadline for reporting was June 10, but the Ministry of Finance only reported on June 19, which is very slow," the document stated.
In addition, this document also determined that the content of the report and recommendations of the Ministry of Finance related to the inspection of contractor selection for the above bidding package did not properly reflect the responsibilities and functions of the state management agency on bidding; did not properly implement regulations on the inspection of contractor selection activities; did not specifically state and analyze the inspection results and did not state the conclusion and specific recommendations for the inspected unit, recommendations for competent authorities.
The Deputy Prime Minister also pointed out the irresponsibility of the Ministry of Finance in implementing the Government's request.
"The Deputy Prime Minister assigned to conduct an inspection of the capacity and experience of the expert team, but the Ministry of Finance reported that it only inspected the bidding certificate and assigned the project management board to be responsible for ensuring the capacity and experience of the expert team members... which is not fulfilling its responsibility," the Deputy Prime Minister's document clearly stated.

The Deputy Prime Minister also pointed out the shortcomings in the scope of the Ministry of Finance's inspection. The Deputy Prime Minister directed the inspection of the organization of contractor selection for this bid package (content of the bidding documents, results of bid evaluation, handling and resolution of recommendations during bidding; capacity and experience of the expert team and other necessary contents), but the Ministry of Finance only concluded that "The evaluation content of the expert team is "not satisfactory".
Urgent request for report and specific recommendations
Deputy Prime Minister Tran Hong Ha requested the Ministry of Finance to promptly report clearly and make specific and clear recommendations in accordance with its functions, tasks and regulations.
First, it is necessary to comment and evaluate whether the content of the E-HSMT (invitation to bid documents) is in accordance with regulations (especially whether the BIM requirements lead to different interpretations; whether the requirements for offering symbols, codes, labels (if any) and origin of main materials and equipment are consistent with the instructions in Circular 22/2024/TT-BKHĐT; whether the requirements for equipment capacity assessment standards and equipment assessment in the technical requirements are consistent or not; if there is any inconsistency, will it affect the E-HSDT assessment results and distort the contractor selection results or not).

Second, the process of evaluating E-HSDT (bidding documents) of contractors by the expert team and the investor has ensured compliance with the requirements of the bidding documents (especially ensuring accuracy, objectivity, and consistency in the evaluation of construction equipment between the requirements on capacity, experience and technical requirements; between the detailed evaluation report of the expert team and the summary evaluation report; the fact that the expert team did not clarify the bidding documents according to regulations ensures the accuracy of the results of the evaluation of the bidding documents).
Finally, regarding the results of contractor selection: Please provide specific comments and assessments on the results of bid evaluation, appraisal, and submission for approval of contractor selection results (whether they are accurate, objective, fair, transparent, and economically efficient, and whether the proposed winning contractor fully meets the requirements on capacity, experience, and feasible solutions to implement the bid package according to the requirements on progress and quality).
In particular, there should be specific and clear recommendations for further handling such as continuing to sign with the selected contractor or requiring the investor, the inviting party, the expert team to complete what content or other necessary measures.
The Deputy Prime Minister requested the Ministry of Finance to coordinate with the Ministry of Construction and the People's Committee of Binh Phuoc province (now Dong Nai province) to complete the report and submit it to the Prime Minister before July 5.
Check the actual capacity of the expert team, not just the certificate
Regarding the capacity of the expert team, the Deputy Prime Minister requested comments and assessments on the capacity, experience, quantity and requirements for the expert team members according to the provisions of the law on bidding, not just through the requirements for certificates.
Special consideration should be given to the aspects of capacity and experience in the distinction between the detailed assessment report and the summary report; no clarification of bidding documents should be carried out...
