Vietnam is the first country to have a law on digital technology industry.

On June 14, the National Assembly passed the Law on Digital Technology Industry, which includes many specific incentive mechanisms for organizations and individuals investing, researching, producing, and doing business in technology fields.

The Law on Digital Technology Industry, drafted by the Ministry of Science and Technology , regulates the development of digital technology industry, semiconductor industry, artificial intelligence, digital assets, controlled testing mechanism, rights and responsibilities of relevant organizations and individuals.

At the 9th Session on June 14, 2025, the 15th National Assembly passed this law with 441/445 delegates in favor. The law takes effect from January 1, 2026. Vietnam officially becomes the first country in the world to issue a separate law on the digital technology industry.

The law identifies strategic digital technology as playing a decisive role in national development, greatly affecting competitiveness, national security and long-term economic growth. Therefore, the Digital Technology Industry Law includes systematic preferential policies, covering the entire industry development chain including financial support, infrastructure, corporate and import-export taxes, land and customs procedures, according to information from the Ministry of Science and Technology.

Regarding business investment activities, the law stipulates that research and development activities of digital technology products and services are entitled to the highest incentives according to the law on science and technology. Accordingly, business expenses and funding for research and development will be included in deductibles when determining taxable income. The calculated level can be 2 to 3 times higher than the actual cost.

In addition, there are preferential mechanisms and support in terms of land and credit to attract domestic and foreign enterprises to invest in research, product manufacturing, and provision of digital technology services.

Enterprises are allowed to conduct controlled testing of products and services applying digital technology, including a mechanism to exclude liability for organizations, enterprises and individuals in the testing.

Regarding human resources, the core factor for developing the digital technology industry, the law stipulates policies for developing human resources for the digital technology industry in educational institutions, enterprises and state agencies. The State supports training costs through national programs, cooperation with enterprises and educational institutions, focusing on advanced technology skills, project management, and innovation.

To attract high-quality digital technology human resources, the law also defines specific policies such as granting temporary residence cards to foreign workers and their families, exempting personal income tax for 5 years, and rotating digital technology human resources between enterprises and the state with high remuneration.

Regarding infrastructure, investment activities in building digital technology industrial infrastructure are identified as a special investment incentive industry, enjoying incentives and support according to the provisions of the law on investment, tax, land and other relevant laws.

The State prioritizes allocating budget capital to invest in building essential, shared digital technology industrial infrastructure such as research, design, and trial production facilities for digital technology products and services, and national shared key laboratories for digital technology.

The Law on Digital Technology Industry has institutionalized the contents of Resolution 57-NQ/TW and Resolution 68-NQ/TW of the Politburo, which is expected to solve major problems of the digital technology industry to promote economic growth, enhance national competitiveness, and improve people's quality of life.
