This is one of the notable contents in Official Dispatch No. 14/CV-BCĐ signed by Minister of Home Affairs Pham Thi Thanh Tra, Deputy Head of the Government Steering Committee on the arrangement of administrative units at all levels and the construction of a 2-level local government organization model, to guide the removal of difficulties and obstacles when operating the 2-level local government organization model.

Accordingly, one of the major current shortcomings is the overlapping authority between the People's Committee at the commune level and the Department of Education and Training in managing the team of teachers, officials and civil servants in the education sector.

Specifically, Clause 10, Article 23 of the Law on Organization of Local Government 2025 stipulates the authority of the Chairman of the People's Committee at the commune level: Direct and organize the implementation of recruitment, use and management of civil servants and public employees in the area according to the provisions of law and decentralization of superior state agencies; decide on appointment, dismissal, transfer, and removal of heads and deputy heads of specialized agencies, other administrative organizations, and public service units under the People's Committee at one level....

Meanwhile, Point b, Clause 4, Article 20 of Decree No. 142/2025/ND-CP dated June 12, 2025 of the Government on the division of authority of local authorities at 02 levels in the field of state management of the Ministry of Education and Training is assigning responsibility to the Department of Education and Training: “Implement recruitment, management, use, appointment, promotion of professional titles, change of professional titles, training, fostering, evaluation... for the team of teachers, management staff, civil servants and employees in public educational institutions in the province according to regulations” .

The above regulation causes difficulties for localities when there are a large number of public service units in the field of education and training in provinces and cities. For example, Can Tho has 1,059 public service units established by 103 commune-level People's Committees. If the Department of Education and Training is assigned to recruit, use, and manage them, it will cause difficulties for the commune level and is not consistent with the spirit of decentralization and delegation of power.

Therefore, the Steering Committee assigned the Ministry of Education and Training the task of Preside over and coordinate with relevant ministries and branches Specific and clear guidance on the authority to manage teachers, management staff, civil servants and workers.

The Ministry of Education and Training is also guided on criteria and procedures to determine the content specified in Clause 4, Article 3 of Circular No. 20/2023/TT-BGDDT dated October 30, 2023 of the Ministry of Education and Training guiding on job positions, staff structure according to professional titles and quotas for the number of people working in general education institutions and public specialized schools, as a basis for localities to properly implement regulations.

At the same time, issue regulations to promote autonomy and socialization in the education sector, especially socialization in preschool and primary schools; provide specific instructions on implementing socialization and service price mechanisms in the education sector to reduce pressure on teacher staffing.

Clear authority to establish Public Administration Service Center

According to the Steering Committee, one of the current problems is the inconsistency in legal regulations on the authority to establish the Public Administration Service Center in the Law on Organization of Local Government 2025 and Decree No. 118/2025/ND-CP of the Government on implementing one-stop administrative procedures, one-stop connection at one-stop departments and the national public service portal.

Therefore, the Steering Committee assigned the Ministry of Home Affairs to Preside over and coordinate with relevant ministries and branches to provide specific and clear guidance on the authority to decide on the establishment of Public Administration Service Centers for unified application by localities.

At the same time, the Ministry of Home Affairs is also assigned to develop and submit to the Government for promulgation a Decree amending and supplementing regulations on the establishment, reorganization, and dissolution of public service units (including public service units under the People's Committees at the commune level).

Develop and submit to competent authorities for promulgation legal documents related to the implementation of the organization of two-level local governments, including: Standards for administrative units and classification of administrative units; criteria, conditions, and procedures for recognition of island communes, safe zone communes, and safe zone areas; organization and operation of villages and residential groups; regulations on the order of establishing and managing administrative unit boundary records.

Along with that are solutions to strengthen the team of specialized and professional human resources for the commune level; implement reasonable incentive policies to attract and retain good cadres to work at the grassroots level.

Regarding finance, the Ministry of Finance Preside over and coordinate with relevant ministries and branches to provide specific guidance and complete the legal mechanisms and policies on norms and unit price standards that are lacking and not suitable to reality. Review and propose amendments and supplements to the Laws related to the assignment of tasks for ordering, bidding for public services, and purchasing public services.

Synthesize and submit to competent authorities to balance the budget, ensure funding sources for the task of reorganizing the apparatus, streamlining the payroll and resolving regimes and policies for subjects retiring according to the regime in Decree No. 178/2024/ND-CP and Decree No. 67/2025/ND-CP.

The document also stated that the Ministry of Finance should promptly provide guidance on resolving and removing difficulties and obstacles within its authority regarding local recommendations regarding working offices and means of service for cadres, civil servants and public employees after the rearrangement.

Promote the application of technology and digitalization

Ministry of Science and Technology is assigned to Preside over and coordinate with ministries, branches and localities to propose a comprehensive plan to improve the quality of technology infrastructure and database infrastructure serving the activities and operations of the Public Administration Service Centers of communes, wards, provinces and cities and connect with ministries, branches and the National Public Service Portal, ensuring smooth and synchronous administrative procedures.

Propose to the Government and the Prime Minister to have solutions to improve digital infrastructure, especially in difficult areas, ethnic minority areas, mountainous areas, islands, borders, and "trough" areas to create favorable conditions for people to access and apply science and technology in life.

Another important content is c Ministries, ministerial-level agencies promptly promulgate ranking criteria and amend and supplement the Circular stipulating ranking criteria for sectors and fields that have changed during organizational restructuring; promulgate and guide criteria and quality standards for public service using the state budget; mechanisms for monitoring, evaluating, and inspecting the quality and regulations for inspecting and accepting public service using the state budget; and operational efficiency of public service units.

Develop mechanisms and policies to encourage non-public service units and enterprises to participate in providing public service services according to market mechanisms to promote the socialization of public service services.

Advise the Prime Minister to amend and supplement the Decisions promulgating the List of public career services using the state budget in the fields currently in effect; it is necessary to supplement the provisions on promulgating the list of public career services using the state budget under the management of localities, consistent with the provisions of Decree No. 60/2021/ND-CP of the Government.

Ministries and sectors regularly organize training and provide professional guidance to cadres, civil servants and public employees of local authorities at the commune level on issues related to the sectors and fields under their management. Training content must be practical and applicable immediately to work.
