The Decree specifically regulates the organization of One-Stop-Shop Departments at ministerial, provincial and communal levels.
At the ministerial level, based on the number of administrative procedures under their jurisdiction, the frequency of receiving dossiers and the arrangement of headquarters, the minister and head of a ministerial-level agency shall decide to establish a Reception and Result Delivery Unit at the ministry, ministerial-level agency directly under the office of the ministry, ministerial-level agency or at the agency or unit directly under the ministry or ministerial-level agency and monitor, supervise and urge the implementation of the one-stop and inter-connected one-stop mechanism at these agencies and units through the Ministry-level Administrative Procedure Processing Information System.
For central agencies organized according to the vertical sector system at the local level, the head of the agency arranges cadres, civil servants, and public employees to work at the provincial-level public administrative service center and the commune-level public administrative service center to receive and handle administrative procedures for administrative procedures under the prescribed authority.
The Minister of National Defense and the Minister of Public Security shall decide on the implementation of the one-stop shop and inter-connected one-stop shop mechanisms in accordance with the working conditions of each ministry.
The Minister of Foreign Affairs decides on the implementation of the one-stop shop and inter-connected one-stop shop mechanism to handle administrative procedures at diplomatic missions, consular missions, and representative missions of Vietnam at international organizations abroad.
At the provincial level, the Provincial People's Committee decides to establish a Provincial Public Administration Service Center, an administrative organization under the Provincial People's Committee Office, with its own seal and account to perform assigned tasks and powers.
In centrally-run cities, based on the specific characteristics of population management, organization of urban life, assessment of the level of application of science and technology , innovation and digital transformation in the city. The City People's Committee decided to establish a provincial-level Public Administration Service Center as an administrative organization under the City People's Committee (a one-level Public Administration Service Center) and decided on the number of branches under the one-level Public Administration Service Center to perform tasks within the locality.
In case this model is not selected, the City People's Committee decides to establish a provincial-level public administrative service center.
At the commune level, the People's Committee of the commune decides to establish the Commune Public Administration Service Center, which is an administrative organization under the People's Committee of the commune, with its own seal and account to perform assigned tasks and powers.
The People's Committee at the commune level decides on the arrangement of reception points and return of administrative procedure settlement results of the commune-level Public Administration Service Center in the locality based on the natural area, population size, socio-economic conditions of the locality and the number of administrative procedure records.
The Decree clearly states that there shall be no public administrative service centers at the commune level under the People's Committees at the commune level in localities that choose the model of one-level public administrative service centers under the People's Committees at the provincial level.
Based on the actual situation, leaders of ministries, branches and localities decide to implement the mechanism of assigning enterprises providing public postal services and enterprises providing services to perform support work to undertake one or several tasks in the process of guiding, receiving, digitizing documents, and returning results of administrative procedure settlement according to the provisions of law on bidding.
Provincial public administrative service centers and commune-level public administrative service centers receive administrative procedures regardless of administrative boundaries within the province.
Organizations and individuals can submit documents and receive results of administrative procedures through methods prescribed in legal documents regulating administrative procedures, including: directly at the One-Stop Department; through public postal services as prescribed by the Prime Minister; through hiring services from enterprises, individuals or through authorization as prescribed by law; online at the National Public Service Portal.
