The Department of Culture and Society is responsible for advising and managing the state on health at the commune level.

The Circular clearly states that the Department of Health is a specialized agency under the People's Committee of the province or city, has legal status, its own seal and account according to the provisions of law; is subject to the direction and management of the organization, staffing and operation of the People's Committee of the province or city; and is subject to the direction, inspection and guidance on expertise and profession of the Ministry of Health .

Regarding duties and powers, the Ministry of Health stipulates that the Department of Health has 30 duties and powers. In particular, the Department of Health submits to the People's Committees of provinces and cities draft resolutions of the People's Councils of provinces and cities, draft decisions of the People's Committees of provinces and cities related to areas under the management of the Department of Health and other documents as assigned by the People's Committees of provinces and cities.

Medical activities at the commune and ward levels will be managed by the local cultural and social department.

Circular 20 also stipulates that the Department of Culture and Society is a specialized agency under the People's Committee at the commune level, advising and assisting the People's Committee at the commune level in performing state management in the health sector and other fields according to the provisions of law; at the same time, it is subject to the direction and management of the organization, job positions, civil servant payroll, civil servant rank structure and work of the People's Committee at the commune level and is subject to the direction, inspection and professional guidance in the health sector of the Department of Health.

The Department of Culture and Society is responsible for advising and assisting the People's Committee at the commune level in performing state management in the health sector, such as: preventive medicine; medical examination, treatment, rehabilitation; mothers and children; population; social protection; traditional medicine and pharmacy; pharmaceuticals and cosmetics; food safety... and other local areas according to the provisions of law.

Assist the People's Committee at the commune level in implementing and taking responsibility for the appraisal, registration, issuance of licenses, certificates and equivalent documents in the health sector within the scope of responsibility and authority of the Department of Culture and Society according to the provisions of law and the assignment of the People's Committee at the commune level; inspect and handle violations in the implementation of legal provisions, professional regulations and technical standards in the health sector for organizations and individuals in the area.
