Exemption from building permit - joy and worry

After the Ho Chi Minh City Department of Construction announced 112 projects eligible for exemption from construction permits (GPXD), wards/communes immediately deployed them to the people. Besides the excitement of not having to waste time applying for construction permits from now on, people have another worry, which is not knowing whether they can build a house and get a pink book or not.

Hope to build a house and get a pink book

The Conic 13B residential area project (in Binh Hung commune) is one of 112 projects announced to be eligible for exemption from construction permits. Here, there are 5 plots of land where people are building houses. Ms. TH, a resident of the Conic 13C residential area, said that she has bought land here for more than 10 years. "I recently heard that I am exempted from construction permits, I am very happy because from now on I do not have to waste time and have complications. However, I am also worried because I did not ask for permission, did not build according to the design, and the wrong house model, will I be able to complete the project or not?" Ms. H. wondered.

Not far from Conic 13B residential area is the 13C residential area project, also in Binh Hung commune, invested by Tan Binh Construction Investment Joint Stock Company (Tan Binh Company), which is also on the list of projects exempted from construction permits this time. The project was implemented in 2002, and in 2004, the investor completed the purchase and sale procedures with customers. However, up to now, the issuance of pink books for 99 plots of land in lots A and B has not been carried out. Mr. Cao Xuan Do, Head of Hamlet 69, Binh Hung commune, said that the wish of the people here is to build houses to live in because they have waited too long. However, there are still some plots in this area that have not been issued pink books because the investor has not fulfilled additional financial obligations. Previously, some impatient people built without permission and were asked to stop by the local government.

At the Ha Do residential area project in Thoi An ward, with Ha Do Group Joint Stock Company as the investor, more than 92% of the individual houses have been built. When hearing the news that the project was exempted from construction permits, local residents were very excited. However, some people were concerned that if construction permits were exempted, would residents be granted pink books or not, because in this area, most of the houses that were built a long time ago have not yet been granted red books. Similarly, in Nha Be commune, nearly 30 housing projects were exempted from construction permits this time, according to Mr. Vo Phan Le Nguyen, Chairman of Nha Be Commune People's Committee, the commune has informed the residents about the projects exempted from construction permits.

Regarding the question of residents of residential area 13C, Mr. Bui Truong Son, Head of the Economic Department of Binh Hung commune, said that the investor must complete financial obligations and be granted a pink book before being allowed to build a house. Mr. Nguyen Dinh Bao Quoc, Vice Chairman of Thoi An Ward People's Committee, informed: The Ha Do residential area project is exempted from granting a construction permit to the investor. Therefore, before starting construction, the investor only needs to send a notice of commencement to the local authorities and the Department of Construction Inspectorate to coordinate inspection during the construction process. After completing the investment in housing construction, completing technical infrastructure works, social infrastructure according to the plan as well as completing financial obligations, the investor contacts the Branch of the City Land Registration Office to complete procedures to grant pink books to home buyers.

In order to effectively implement the exemption of construction permits, the Department of Construction of Ho Chi Minh City has requested the People's Committees at the commune level to publicly post the list of projects within their administrative boundaries that are eligible for exemption of construction permits; instruct individuals and organizations to comply with approved planning and comply with legal regulations on construction commencement when receiving notice of construction commencement time. Along with that, the Department of Agriculture and Environment of Ho Chi Minh City presides over and coordinates with the City Land Registration Office to review current regulations to guide the People's Committees of wards/communes to uniformly and synchronously implement the work of handling procedures for granting certificates of ownership of works for individual houses according to the lists announced by the Department of Construction.

In the near future, the department plans to implement a plan to review and organize the establishment of a detailed plan at a scale of 1/500 covering urban areas along major national and city-level traffic routes with investment and expansion plans approved by competent authorities such as Ring Road 2, Ring Road 3, Ring Road 4, National Highway 1, National Highway 22, etc. to exempt individual housing construction permits. Mr. Huynh Thanh Khiet, Deputy Director of the Ho Chi Minh City Department of Construction, added that the department will continue to review projects that are eligible for exemption from construction permits and announce them in several batches; at the same time, review the legal basis so that the announcement of projects exempted from construction permits is consistent with current regulations.

Procedures for notification of construction commencement in construction permit-exempt areas

- Have legal documents on land according to the provisions of Article 53 of Decree No. 175/2024/ND-CP dated December 30, 2024 of the Government , with the purpose of using land as residential land, not to carry out construction if the land is in dispute or there is a decision to prevent changing the current status/transfer of assets by a competent authority and must have written consent from the bank (in case of mortgage).

- Design and construct individual houses in accordance with the architectural planning standards in the detailed planning at a scale of 1/500 (or the master plan at a scale of 1/500 and the architectural plan of the project) approved or accepted by a competent state agency according to regulations.

- Send notice of construction commencement time, construction design documents as prescribed (with certified copies of legal land documents) to the local state construction management agency (Commune-level People's Committee) at least 3 working days before construction commencement for management.
