On August 31, Mr. Le Hoang Chau, Chairman of the Ho Chi Minh City Real Estate Association (HoREA), continued to send recommendations to the Government and relevant ministries and branches to contribute comments on the draft revised Land Law 2024. HoREA believes that some current regulations are not suitable. Among them is the proposal to add regulations on changing land use purposes of state-owned enterprises that were equitized in the period 2007-2021.
According to Mr. Chau, before the issuance of Decree 109/2007, the law did not require the establishment of a land use plan when equitizing. It was not until 2021 that detailed instructions were provided on the establishment and approval of this plan. Therefore, most enterprises equitized in the period 2007-2021 did not have a plan approved by the competent authority, leading to confusion when wanting to change the land use purpose.
In fact, many land plots after equitization are no longer suitable for current planning. Enterprises have the need to convert according to the new planning, are willing to pay land use fees and land rent, but because there are no clear regulations, localities are hesitant and do not resolve the issue, causing land resources to be wasted. Therefore, HoREA believes that adding this regulation will not only help exploit land funds effectively, create budget revenue, but also ensure a legal corridor for officials to handle procedures.
In addition, the association also proposed reducing land use fees for individuals and households to reduce the burden, because the land price list under the new law has increased sharply compared to before, if people owe money, they are still bound by many things.
