This morning, the National Assembly Standing Committee gave opinions on the reception, explanation, and revision of the draft Law amending and supplementing a number of articles of the Law on Planning (draft law).

National Assembly Chairman Tran Thanh Man raised the question: The Planning Law has been amended many times, "but why do localities still complain about problems and where they are stuck, "is it because the law is unclear or because of the decree?"
He stated that this merger of provinces and cities is expected to implement the Law on Planning. Therefore, he suggested that from now until the draft law is passed, the opinions of the chairmen of the provinces and cities in the merger area should be sought in various forms.

According to the National Assembly Chairman, whatever problems we had in the past must be fundamentally fixed this time.
"At the 9th session, the Law on Planning was amended to streamline and organize the apparatus. If we amend and make laws but cannot implement them, it will be very difficult," Mr. Man noted.
He also asked members of the National Assembly Standing Committee to contribute their opinions, along with the opinions of National Assembly deputies in the spirit of "resolving difficulties and clearing blockages". He noted that it should be done immediately to serve the merger of provinces and cities.
According to the National Assembly Chairman, at the second meeting of the 9th session on June 12, the project to merge provincial-level administrative units will be discussed and voted on. If the National Assembly agrees to pass, the resolution to merge 34 provinces and cities will be signed the following day.
"Therefore, this revised Law on Planning is extremely important" - the National Assembly Chairman emphasized.
He said that although the National Assembly delegates did not have any comments on the discussion, the process of directing and operating from the central to local levels still had to remove the planning. Even though a monitoring team was set up to implement the Planning Law, after reporting to the National Assembly with a resolution to remove the problems, the localities still complained that it was difficult and could not be done.
Citing lessons learned from the revision of the Health Insurance Law, the National Assembly Chairman said that when the problem was discovered and the law was revised, people were extremely excited. This was because the revision of the law had solved and simplified the procedures for hospital transfers, referrals, and requests for hospital transfer papers.
He said that through the process of group discussion, especially the issues reflected by localities, we must absorb them to make corrections, "whatever difficulties the localities find, we must resolve them in this law...".
Will continue to study to submit to the National Assembly to fundamentally amend after merging provinces and cities.
Explaining at the meeting, Finance Minister Nguyen Van Thang said that the Law on Planning passed by the National Assembly has fundamentally and comprehensively changed the previous laws. However, the implementation process is stuck because 63 provinces and cities are jointly planning while there are not many consultants.
"Somewhere, many places do not meet the requirements, so when it comes to implementation, problems start to arise..." - Mr. Thang said.

He pointed out that the Planning Law has never been fundamentally amended. This time the law is amended due to the requirements of changing administrative boundaries, merging provinces, and changing local government from 3 levels to 2 levels.
The Minister said that after the merger is completed, it is certain that it is necessary to continue to comprehensively amend the Planning Law, possibly at the 10th session or the first session of the new National Assembly term.
Asking a question later, National Assembly Chairman Tran Thanh Man said: "This time, the amendment is in accordance with the spirit of Resolution 127. The Minister committed that localities will be able to implement it, right?"
He also suggested that when completing the acceptance, the Minister of Finance should consult with localities to re-enter, see if there is any additional content that needs to be revised; assess the compatibility between different types of planning; review the provisions of related laws...

The Ministry of Finance has completed the draft decree and is collecting opinions from ministries, branches and localities for approval by the National Assembly and timely promulgation from July 1.
"When merging, the strategies of localities will also change, especially in terms of development space. When localities follow the new model, the Government will continue to study to submit to the National Assembly to fundamentally amend this law," the Minister affirmed.
