Discussing the amendment and supplementation of a number of articles of the draft Law (Article 1) in Clause 3 (Developing a system of national standards and technical regulations to ensure the consistency and synchronization of national quality infrastructure, creating conditions for the development of international standards for key, priority, key and specific products of Vietnam to meet the requirements of the socio-economic development strategy, industry development strategy, national key programs and projects and international integration requirements to enhance national competitiveness. However, to have more specific regulations, delegate Huong suggested that further research should be conducted in the following directions: More clearly defining the stages, periods, viewpoints, goals, and visions of the strategy; more clearly defining the national standardization agency to ensure compliance with international practices; supplementing principles and bases for building the strategy, unifying and synchronizing with the development strategies of other sectors and fields.
In Clause 4 (Developing a national digital platform on standards and technical regulations to connect and share among ministries, branches, localities, and enterprises; promoting standards on digital transformation, digitization, unique identification, data encoding in machine-readable language, identifying and collecting data related to management objects in the supply value chain, global connection) of the draft Law, delegate Huong suggested that it is necessary to study and specify more clearly the notification of basic standards: The notification of these basic standards can be done after the products have been put into circulation; the form of notification is in the electronic environment, accordingly, the system will automatically receive and confirm receipt of the enterprise's dossier.
In Clause 7 (The State supports resources for Vietnamese representatives to participate in international and regional standardization organizations, fully performing their responsibilities and obligations as members) of the draft Law, delegate Huong suggested that it is necessary to study and clearly stipulate to clearly distinguish the authority to publish and distribute Vietnamese Standards, the copyright responsibility of the entity drafting Vietnamese Standards, avoiding duplication of authority and responsibility.
In addition, according to delegate Dang Thi My Huong, the current Law on Standards and Quality Regulations stipulates that enterprises must carry out the conformity declaration procedures themselves after using the conformity certification service of a service provider. In fact, many units are providing a full package of services including conformity assessment and conformity declaration procedures, but still submit the application under the name of the enterprise. Therefore, it is necessary to study and amend in the direction that enterprises can submit the conformity declaration application themselves or authorize the conformity assessment unit to submit the application.
In order to avoid the case of protecting products that have met national standards, it is recommended to study and supplement the draft Law in the direction that: products that meet national standards will be applied nationwide and will not be subject to the regulation of the Law on Intellectual Property.
