Participating in giving opinions on the draft Law on Judicial Assistance in Civil Matters, the National Assembly deputies highly agreed on the necessity of promulgating the draft law; at the same time, they believed that the development of the Law aims to perfect the law on judicial assistance in civil matters in a modern and feasible direction, promote international cooperation, and support the process of resolving civil cases (in a broad sense) and administrative cases with foreign elements quickly, accurately and effectively.

At the same time, it helps protect the legitimate rights and interests of relevant subjects, enhances the ability to exercise people's right to access justice; creates a foundation for signing and implementing international treaties on mutual legal assistance in civil matters.

Delegates focused on discussing the scope of civil judicial assistance (Article 3) and basically agreed with the provisions on the scope.

However, opinions say that the provisions in the clauses of Article 3 are not yet strict, and the purpose of providing legal information is unclear, whether it is to serve the settlement of cases or incidents or to serve other purposes.

Therefore, it is recommended to continue reviewing and clearly defining regulations so that after the Law comes into effect, it can be implemented smoothly and consistently.

National Assembly Deputy Mai Van Hai, member of the Provincial Party Committee, Deputy Head of the National Assembly Delegation of Thanh Hoa Province, said that the draft Law stipulates 6 contents of judicial assistance in civil matters. However, the new scope mainly refers to issues related to personal status and nationality, but does not clearly mention the scope of assistance in matters related to assets, agencies, organizations, and individuals within the scope of assistance. Therefore, the draft Law needs to stipulate more clearly the scope of judicial assistance in civil matters.

The delegates also basically agreed with the provisions on the authority to request civil judicial assistance stated in the draft Law, however, they suggested that it is necessary to clarify the provisions for other agencies with the authority to request civil judicial assistance as prescribed by law. According to the delegates, the draft Law should mainly stipulate the judicial agencies with the authority to request civil judicial assistance...

Commenting on the draft Law on Mutual Legal Assistance in Criminal Matters, National Assembly Deputies said that the drafting of the Law will perfect the legal regulations on mutual legal assistance in criminal matters by separating the legal regulations on mutual legal assistance in criminal matters from the 2007 Law on Mutual Legal Assistance into a separate law.

Thereby, responding to the Party's guidelines and policies, the State's policies on judicial reform and enhancing international integration and cooperation in the judicial field; ensuring compatibility and synchronization with the domestic legal system and Vietnam's international commitments in the same field; overcoming limitations and shortcomings in the current Law on Judicial Assistance; contributing to improving the effectiveness of the fight against crime, better protecting the rights and legitimate interests of organizations and individuals.
