Participating in giving comments, delegate To Van Tam ( Kon Tum delegation) expressed his approval and appreciation for the Government's report on the socio-economic situation in 2024 and the first months of 2025.
Delegates said that data showed that in 2023, market management forces detected and handled 52,251 violations of smuggling, trade fraud, and counterfeit goods. In 2024, 47,135 cases were detected and handled. In the first 4 months of 2025, localities and units arrested and handled more than 34,000 violations.
“More than 4,892 billion VND was paid to the state budget, 1,451 criminal cases were prosecuted, and more than 2,100 subjects were prosecuted. This situation shows that the production and trade of counterfeit goods, fake goods, trade fraud, and smuggling have barely decreased and are becoming more complicated, despite the efforts of the authorities.
Counterfeit and fake goods not only cause economic damage but also directly threaten the health and lives of people as consumers, undermine the brand reputation of legitimate businesses, reduce people's trust in the country's goods, hinder economic development, cause loss of state budget revenue, cause social instability and investment environment," said the delegate.
Delegate To Van Tam said that the case of more than half a million counterfeit products existing on the market for nearly 5 years, and then the fake food, fake medicine, fake cosmetics and other counterfeit goods circulating on the market for many years shows that the tricks of the subjects producing and trading counterfeit goods are very sophisticated and complicated.
In particular, according to the delegate, the counterfeit goods production and trading ring, trading hundreds of tons of functional foods related to a senior official of a specialized ministry, was prosecuted by the Ministry of Public Security's investigation police agency, and a number of other cases showed the complicity of a number of officials who had degraded their moral qualities and lifestyle.
“In addition to the phenomenon of counterfeit goods flooding social networks with the promotion of some influential people and celebrities with loud advertisements, the picture of counterfeit goods has enough horrifying colors, making it difficult for even the most knowledgeable consumers to distinguish fake products circulating on the market,” said the delegate.
The delegate acknowledged that recently, the National Competition Commission has announced the handling of businesses that intentionally spread false information through advertising, promotion, and trade promotion activities.
“The handling has been very drastic, with strict penalties. The authorities have inspected, detected and handled many subjects producing and trading counterfeit goods, committing commercial fraud, and imposed fines that have collected thousands of billions of VND from the state budget. Many cases and individuals have been prosecuted.
On March 8, 2025, the Government issued Decree 46, emphasizing the strengthening of market management, the fight against smuggling, trade fraud and counterfeit goods. This demonstrates the Government's responsibility and determination in preventing, stopping and strictly handling acts of manufacturing and trading counterfeit goods to protect consumer rights and ensure healthy market order," the delegate said.
To continue to effectively and efficiently prevent counterfeit goods and trade fraud, delegates suggested that the Government pay attention to a number of issues.
The management of production and trade of goods and food safety has been decentralized to authorities from central to local levels, but the situation of counterfeit goods and trade fraud remains complicated.
The Government needs to strengthen inspection and review of the process of organizing the implementation of functions and tasks of those agencies, and review the consistency in management and inspection. Is there a situation where there are many management and control agencies but the activities are not unified? Or is there an overlap in management, where are the loopholes to be corrected and handled promptly?
Second, we have a fairly complete legal framework on preventing counterfeit goods and commercial fraud such as the law on consumer rights protection, the law on product quality, the civil code and are being reviewed and supplemented to ensure consistency.
But to compensate consumers for damages and losses in money, health and life is almost never done in practice, because of difficulties.
“The difficulty that consumers often encounter here is how to prove that the goods are fake, and the problem of appraisal to determine the level of error is very difficult.
Therefore, the Government needs to promote legal aid activities, legal advice, judicial support, and strengthen propaganda and legal education so that people can effectively use this tool to protect their rights," said the delegate.
Third, counterfeit goods and commercial fraud can be considered a national disaster in many aspects because of the social consequences it creates, because the social and ethical consequences are very serious, large-scale, sophisticated and there is a phenomenon of collusion between some public officials with degraded moral quality and lifestyle.
"Therefore, the prevention of counterfeit goods and trade fraud must be raised to a national level, a national strategic level, so that we can make decisions to further improve the effectiveness of the prevention of counterfeit goods and trade fraud," the delegate suggested.
Sharing the same view, delegate Le Huu Tri (Khanh Hoa delegation) said that the positive results of 2024 and the first 5 months of 2025 have created a solid foundation and confidence for setting an 8% growth target in 2025.
This is a testament to the outstanding efforts of the entire political system and people of the country in a context of many complex political and economic fluctuations in the world. The Party, National Assembly and Government have identified priority for promoting economic growth and improving institutions.
Our Party has issued strategic resolutions such as Resolution No. 66 on innovation in law making and enforcement to meet the requirements of national development in the new era and Resolution No. 68 on private economic development.
The ninth session of the 15th National Assembly also focused on building and perfecting specific and breakthrough legal policies and institutions to remove institutional bottlenecks and create an open legal environment for economic sectors, especially the private economy, to create and develop.
However, according to the delegate, perfecting the law is not enough. The important and decisive issue is to pay special attention to improving the effectiveness of law enforcement.
In particular, according to the delegate, our country is striving to build a civilized and happy society, requiring us to resolutely fight against all types of crime, especially counterfeit goods, fake drugs, and toxic dirty food, which are serious threats to people's health, lives and trust.
"There needs to be a strict legal framework to handle and publicize information so that people know how to boycott fake and counterfeit goods, especially fake drugs and toxic dirty food," the delegate said.
According to the delegate, we are also facing the reality of cybercrime occurring every day with increasingly sophisticated and aggressive nature, terrorizing, threatening, defrauding, and appropriating people's property.
“The situation of increasing crime of illegal drug trafficking and use on a large scale. Public opinion has been asking: We have a comprehensive legal system that covers all aspects of all fields. We have many forces to manage society, from the border, inland border gates, residential areas, but hundreds of tons of fake drugs, fake functional foods, fake food and drinks are produced, circulated, traded and sold in pharmacies, stores, shops that operate legally and are present even in hospitals with cases. Dozens of tons of drugs enter our country and the number of addicts is increasing. It is time for our country to not take this problem lightly,” the delegate suggested.
According to the delegate, it is necessary to quickly change the method of social management to be more effective, not allowing these types of crimes to exist and develop. There needs to be a legal corridor to strictly punish these types of crimes, there needs to be purges to detect and strictly handle law enforcement officers who have covered up and tolerated criminal acts.
“All Vietnamese people want a prosperous and happy life, a civilized, clean and peaceful living environment and people are also expecting drastic and effective actions from the government and authorities at all levels,” said the delegate.
