Commune level establishes schools, manages extra teaching, organizes competitions for excellent teachers

The Ministry of Education and Training issues regulations on the division of authority to perform state management tasks of local authorities at two levels in the field of education.

From today, July 1, localities across the country will operate a two-level government model. In the field ofeducation , from today there will also be many changes when there are no longer People's Committees and Departments of Education and Training at the district level.

To ensure the smooth operation of state management in the field of education,   The Ministry of Education and Training has issued circulars regulating the decentralization, delegation and assignment of authority to perform state management tasks of local authorities at two levels for preschool education and general education.

Commune-level People's Committees manage many contents related to education from preschool to secondary school.

Basically, the authority and responsibilities related to education at all levels from preschool, primary to secondary school, before July 1 belonged to the Chairman of the People's Committee, the District People's Committee and the District Education and Training Department, and were transferred to the Chairman of the People's Committee and the Commune People's Committee.

The authority to establish or permit the establishment, permit educational activities, suspend educational activities, merge, divide, separate, and dissolve kindergartens, primary schools, secondary schools, and general schools with multiple levels of education, with the highest level being secondary schools, is exercised by the Chairman of the People's Committee at the commune level.

The authority to establish or permit the establishment, merger, division, separation, or dissolution of high schools and general schools with multiple levels of education, with the highest level of education being high school, is exercised by the Chairman of the Provincial People's Committee.

The authority to permit educational activities and suspend educational activities for high schools and general schools with multiple levels of education, with the highest level being high school, is exercised by the director of the Department of Education and Training.

Regarding the organization of implementation of regulations on school transfer and admission of students to secondary schools, the authority to issue school transfer and admission letters for secondary schools is exercised by the Chairman of the People's Committee at the commune level.

The contents that the Chairman of the People's Committee at the commune level has the authority to implement include: establishing kindergartens, primary schools, secondary schools and multi-level general schools with the highest level being secondary school; recognizing the school council and chairman of the school council for primary schools, secondary schools and multi-level general schools with the highest level being secondary school.

Recognize principals and vice principals of kindergartens, primary schools, secondary schools and multi-level general schools with the highest level being private secondary schools; establish a council to consider and recognize secondary school graduation, decide on graduation recognition, announce the list of students recognized as graduating from secondary schools, and organize the issuance of graduation certificates to students recognized as graduating.

Commune level management of extra teaching and learning activities

The People's Committee at the commune level also has the authority to manage extra teaching and learning activities in the area; guide and inspect the implementation of regulations on extra teaching and learning in the area; handle or recommend to competent authorities to handle violations; monitor and inspect compliance with legal regulations on working hours, overtime and legal regulations on security, order, safety, environmental sanitation, fire prevention and fighting of organizations and individuals providing extra teaching and learning outside of school.

The authority to establish the admission council for preschool, primary and secondary schools, approve the admission plan, and approve the list of successful candidates (except for schools belonging to universities, colleges, and research institutes) is exercised by the Chairman of the People's Committee at the commune level. The authority to direct and manage the admission work from preschool to secondary schools is exercised by the People's Committee at the commune level.

Previously, the district-level competition for excellent teachers and homeroom teachers was organized by the Department of Education and Training for preschool, primary and secondary school teachers in the area. From now on, the competition will be organized by the People's Committee at the commune level.

The phrase "excellent teachers from district level and above" is replaced by the phrase "excellent teachers from commune level and above" and "certificates of merit from commune level and above" in job descriptions of preschool, primary and secondary school teachers.
