According to the reflection of Mr. Nguyen Van Lai (born in 1963), residing in Hoang Dong village 2, Minh Son commune (Trieu Son district, Thanh Hoa province), in July 2014, the People's Committee of Minh Son commune had a written agreement with his family to exchange 950m2 of the family's residential land (adjacent to the kindergarten) for another piece of land (road to the commune health station) with an area of ​​210m2 (6m wide, 35m long).

According to the agreement, Mr. Lai is responsible for clearing the land, trees and crops, and handing over the land to the commune for management to carry out the construction of the head office and classrooms of Minh Son Commune Kindergarten. Minh Son Commune People's Committee is responsible for planning and submitting the paperwork to the competent authority for approval to hand over the land to Mr. Lai's household.

In July 2014, Minh Son commune supported Mr. Lai with more than 50 million VND for site clearance and land allocation, and proceeded to build the school's headquarters and classrooms.

Eleven years have passed, but Mr. Lai's family still has not received the land as agreed, forcing him to build a fence to get his family's land back.

According to the leader of Minh Son Commune Kindergarten, on June 8, Mr. Lai's family brought materials to the school to build a fence across the school yard, seriously affecting the care,education and professional activities of the school.

The school leader added that this was not the first time Mr. Lai had acted like this. Previously, every year Mr. Lai had also taken actions to “demand land”, disrupting opening and closing ceremonies, causing anxiety among teachers and parents.

Speaking with VietNamNet, Mr. Nguyen Van My, Chairman of the People's Committee of Minh Son commune, confirmed that Mr. Lai had built a fence in the middle of the kindergarten yard. The government is currently mobilizing the family to voluntarily dismantle the wall.

According to Mr. My, the reason for the above situation was that the commune chairman had previously agreed to exchange land between Mr. Lai's family and the commune People's Committee to build a school building and classrooms for the kindergarten. However, up to now, Mr. Lai's family has not received the land, so they have built a fence with the purpose of reclaiming the family's old land.

“I don’t know how the land exchange happened before, because I just came here as the commune chairman. The matter has been going on for quite a long time. The commune and district have tried to resolve and reconcile many times but failed,” said Mr. My.

According to Mr. My, according to regulations, the commune level does not have the authority to carry out the above land exchange, so it is impossible to arrange land for Mr. Lai's family.

“Through the working sessions, Mr. Lai proposed that if the land is not returned as agreed, the locality can pay cash with the current value of 3.3 billion VND. In addition, the commune must compensate for production losses over the past 11 years of 550 million VND.

The commune cannot meet the above amount. Mr. Lai has also filed a lawsuit. We are waiting for the court's decision to have a suitable solution. Once the court has made a decision, the commune must implement the final result," said Mr. My.
