Improving the effectiveness of legal document drafting is considered an urgent and prerequisite task to realize the Party and State's policies and guidelines, while at the same time creating a strong administrative foundation to serve security, politics , economy and society. In the context that the entire Party, the entire people and the entire political system are promoting the "Institutional Revolution", bringing the country into a new era, an era of prosperous and powerful development, the system of legal documents (LDOs) must ensure consistency, transparency, stability and feasibility; both upholding the rule of law and creating an open legal corridor, promoting innovation and sustainable development.
During the 2020-2025 term, the work of drafting, appraising, inspecting, reviewing and systematizing legal documents of the province achieved many positive and clear results, contributing to the institutionalization of the Resolutions of the Party Congresses at all levels. The Department of Justice advised the Provincial People's Committee to issue Directive No. 06/CT-UBND dated August 19, 2021 on improving the quality of drafting legal documents, perfecting the legal system and enhancing the effectiveness of law enforcement; significantly contributing to improving and maintaining the ranking of the Law Compliance Cost Index (Index B1) of the province.
The Department of Justice has advised on the issuance of 5 resolutions and 3 decisions; appraised 56 proposals for drafting resolutions; 475 draft legal documents; and inspected 357 documents issued by the People's Council and People's Committee at the district level. Thereby, 32 erroneous and illegal documents were discovered and promptly recommended to agencies, units and localities for amendments and supplements. Every year, the Department submits and publishes the List of documents that have expired or ceased to be effective and the results of reviewing and systematizing legal documents of the Provincial People's Council and People's Committee. All legal documents issued by the Provincial People's Council and People's Committee during the term have been fully updated in the National Database.
To ensure that the Law on Promulgation of Legal Documents 2025 is concretized and put into practice, the Department has advised the Provincial People's Committee to issue Decision No. 3056/QD-UBND dated August 5, 2025 to implement the Law on Promulgation of Legal Documents 2025 in the province and issue documents guiding the process and procedures for advising on the development and promulgation of legal documents of the People's Council and People's Committee at the provincial level, of the People's Council and People's Committee of communes, wards and special zones. In particular, to promote the implementation of Resolution No. 66-NQ/TW dated April 30, 2025 of the Politburo on innovation in law-making and enforcement to meet the requirements of national development in the new era, the Department of Justice has proactively advised the promulgation of Action Program No. 50-CTr/TU of the Provincial Party Committee Standing Committee and Decision No. 2161/QD-UBND of the Provincial People's Committee.
Regarding the arrangement of administrative units and state apparatus organization to implement Resolution No. 18-NQ/TW dated October 25, 2017 on innovation and arrangement of the apparatus organization and Resolution No. 190/2025/QH15 regulating the handling of a number of related issues, the Department of Justice has promptly advised on reviewing the system of local legal documents affected. With only effective Provincial People's Council Resolutions, the Department of Justice has reviewed 115 resolutions, of which it recommended abolishing 23 resolutions, amending and supplementing 25 resolutions and issuing 26 new resolutions to replace them. Along with that, the system for receiving and handling feedback and recommendations on legal documents has been deployed and operated effectively, becoming an important connection channel between the government and people and businesses.
Ms. Nguyen Thi Van Anh, Deputy Head of the Office of Documents and Law Enforcement Monitoring, Department of Justice, said: “In the coming time, the Office will continue to focus on inspection and handling; review and systematize legal documents associated with evaluating the effectiveness of law enforcement after promulgation; promptly advise on handling legal difficulties and problems; at the same time, proactively coordinate with departments and branches to advise the Provincial People's Committee in developing and promulgating legal documents to ensure proper authority and procedures; strengthen the inspection, review and systematization of legal documents to detect conflicts and overlaps, propose timely amendments, supplements and abolition of inappropriate regulations; apply technology to participate in building a local legal database linked with the Central. Thereby, creating a transparent and stable legal environment; contributing to promoting local socio-economic development; ensuring human rights, civil rights and building a socialist rule-of-law state. "The judiciary is strong and contributes effectively to the goal of turning Quang Ninh into a centrally-run city by 2030."
