Conclusion No. 09/KL-TTr just announced by the Inspectorate of the Ministry of Agriculture and Environment shows that in the process of complying with the law on land, environment, water resources and minerals, the People's Committee of Quang Binh province has made many efforts, but there are still many violations, lasting in many areas, especially related to land and water resources.

According to the conclusion, up to the time of inspection, Quang Binh had only issued 22 legal documents in related fields, but there were still 52 missing documents under local authority that must be issued according to the 2024 Land Law and guiding decrees.
Some issued documents even repeat the content of the law, do not comply with the provisions on authority and present the content in detail, not in accordance with Article 11 of the Law on Promulgation of Legal Documents.
In particular, in the environmental field, although 5 documents have been issued, there are still 12 contents that have not been regulated or guided as required in the Plan for implementing the Law on Environmental Protection 2020.

During the 2014-2023 period, Quang Binh province reclaimed more than 3,123 hectares of land and allocated and leased more than 8,533 hectares of land to organizations and individuals; of which 34 cases were commercial housing and urban area projects.
However, through inspection of 8 key projects, the inspection team discovered a series of violations. These include: organizing bidding in violation of regulations for projects that are not urban areas according to the law; there are projects containing public assets that have not been processed but are still bidding; some projects have not determined land prices or have not signed commercial service land lease contracts. Up to 8 projects were allocated land without assessing land use needs and allocated land before completing financial obligations, contrary to the provisions of the 2013 Land Law.
Regarding handling slow-progressing projects, the province has reclaimed land from 17 projects and extended the deadline for 29 projects, but many overdue projects have not been reclaimed despite owing billions of dong in land rent, including projects that have lasted for 5-6 years.

From 2013 to 2023, the province issued more than 200 water resource licenses, collecting nearly 10 billion VND in licensing fees. However, the inspection conclusion pointed out many serious violations; such as: granting licenses to subjects not required to be granted (05 cases); not promptly handling administrative violations of enterprises exploiting water without permission; granting licenses with incorrect forms, lacking legal basis, validity period...
Quang Binh province currently has 114 valid mineral exploitation licenses. However, the inspection team discovered that many licenses had incomplete documents and lacked regulations on zoning without auction, including some licenses that approved selling to the market that were not in accordance with the original objectives.
In particular, 9 licenses were surveyed by organizations without a license to survey and map, seriously violating the provisions of the Law on Surveying and Mapping. Some licenses incorrectly determined reserves to calculate mining rights fees, causing loss of budget revenue.
The Inspectorate of the Ministry of Agriculture and Environment assessed that Quang Binh province has made certain efforts in the management of natural resources and the environment, but shortcomings and violations are still widespread, prolonged and repeated in many areas. In particular, the lax management of public land, improper land allocation, slow handling of violating projects, along with errors in licensing natural resources and minerals, if not rectified, will affect the discipline and transparency in land and resource management in the locality.
