Implementing the direction of Deputy Prime Minister Tran Hong Ha (in Official Dispatch No. 2547/VPCP-CN dated April 14, 2023 of the Government Office) on reporting on the management of licensing, exploration and exploitation of minerals for common construction materials in the period of 2019-2021 nationwide, the People's Committee of Phu Yen province proposed the Ministry of Natural Resources and Environment and the Ministry of Construction to issue guiding documents to implement the exploitation, processing and use of minerals for construction materials if minerals are found to ensure the requirements on quality and reserves for paving stones, raw materials for cement production and industrial lime in the process of planning management, licensing and mineral activities for common construction materials in the province.

Accordingly, the People's Committee of Phu Yen province stated that, according to the provisions of the law on the organization of planning and exploitation of minerals for construction materials, it only stipulates that organizations and individuals are responsible for protecting unexploited minerals in the land area in use and stipulates that organizations and individuals engaged in mineral exploitation activities, if they discover minerals, must immediately notify the competent State management agency that grants the license as prescribed in Article 17 of the 2010 Law on Minerals; there are no detailed regulations for implementation if there is a case in which an organization or individual exploiting minerals for construction materials discovers minerals that meet the requirements on quality and reserves for making paving stones, raw materials for producing cement and industrial lime for the State management agency to implement to ensure the rights of investors and the responsibility of the State management agency in the field of minerals.

In addition, the mineral mines used for common construction materials in the province that are being exploited have not discovered minerals that meet the requirements for quality and reserves for paving stones, raw materials for cement production and industrial lime. In the future, if organizations and individuals exploiting minerals for construction materials discover minerals that meet the requirements for quality and reserves for paving stones, raw materials for cement production and industrial lime at the mines they are exploiting, there will be no legal basis for state management agencies, relevant organizations and individuals to implement.

Currently, mining minerals for common construction materials in Phu Yen province, based on the approved mineral planning, the Provincial People's Committee has issued 34 mining licenses (still in the exploitation period), including 16 construction stone mines (total area of 95.78 ha); 7 landfill mines (total area of 56.75 ha); 11 construction sand mines (total area of 72 ha). Up to now, there are a total of 19 mining sites exploiting minerals to supply construction needs in the province (9 construction stone mines, 8 construction sand mines, 2 landfill mines).
