The National Assembly delegation of Ha Tinh contributed many specific and accurate opinions, contributing to the completion of the draft Law on Organization of People's Courts (amended).
Continuing the 6th Session, on the afternoon of November 9, the National Assembly discussed in groups the draft Law on Organization of People's Courts (amended).

Participating in the discussion, the National Assembly deputies of Ha Tinh delegation agreed that amending the Law on Organization of People's Courts is necessary to continue perfecting the organizational apparatus, improving the quality, efficiency and effectiveness of the operations of people's courts; building a professional, modern, fair, strict, honest court system that serves the Fatherland and the people.
Delegates focused on discussing: scope of regulation; specialized first-instance people's courts; organizational structure of the Supreme People's Court; reorganization of the supporting apparatus of high-level people's courts ; innovation of provincial and district-level people's courts according to jurisdiction; regulations on not conducting inspections and investigations into trial activities and resolving cases in the process of litigation.
Delegates proposed not to establish the National Judicial Council, maintain the regulations and supplement the tasks and powers of the National Council for Selection and Supervision of Judges, improve effectiveness and efficiency, contribute to ensuring independence between trial levels, not increase focal points and staff; promote responsibility, strengthen discipline, order and supervision of judges.
Delegates discussed a number of issues related to People's Court judges such as: regulations on judge ranks and grades; authority to decide on the number of judges and judge grades at each court level, judge grade structure; age of appointment of judges; conditions for appointment of judges; mechanism to protect judges.
Agree to the proposal not to stipulate that the Trial Council has the duty to prosecute the case at the trial; the regulation of the term of office of judges is 5 years is appropriate, adding the authority to adjudicate administrative violations according to the provisions of the law. Review the regulations related to salaries and allowances to ensure consistency with the Government's new salary reform policy.
The proposal to establish a specialized first-instance people's court must be drafted and submitted to the National Assembly Standing Committee for consideration and decision; appropriate measures must be taken regarding the organization of personnel for judges of the Supreme People's Court and judges who violate criminal law.
Delegates suggested reviewing the provisions of the draft Law to ensure consistency and uniformity in the legal system; fully regulating the content of the court's exercise of judicial power, ensuring connectivity and connection with the tasks and powers of the court, having an effective power control mechanism; clearly defining the court's responsibility in guiding and supporting the collection of evidence for vulnerable litigants. At the same time, it was recommended to innovate and improve the quality of the court's human resources, ensuring that judges are encouraged to focus on their work.
