Proposal to amend income conditions for purchasing or leasing social housing

The Ministry of Construction is drafting a Decree amending and supplementing a number of articles of Decree No. 100/2024/ND-CP dated July 26, 2024 of the Government detailing a number of articles of the Housing Law on the development and management of social housing.

The Ministry of Construction proposed amending regulations on income conditions to be eligible to buy or rent-purchase social housing.

According to the provisions of Clause 1, Article 30 of Decree No. 100/2024/ND-CP, the income conditions for purchasing or leasing social housing for subjects specified in Clauses 5, 6 and 8, Article 76 of the Housing Law are as follows:

In case the applicant is single, the actual monthly income received must not exceed 15 million VND, calculated according to the Salary and Wage Table confirmed by the agency, unit, or enterprise where the applicant works.

In case the applicant is married according to the law, the applicant and his/her spouse must have a total monthly income of no more than 30 million VND calculated according to the Salary and Wage Table confirmed by the agency, unit or enterprise where the applicant works.

The time for determining income conditions within 01 consecutive year, calculated from the time the subject specified in this clause submits a valid application to the investor to register to buy or lease-purchase social housing.

In the draft, the Ministry of Construction proposed to amend the regulations on income conditions for purchasing or leasing social housing as prescribed in Clause 1, Article 30 of Decree No. 100/2024/ND-CP in the direction of: Raising the income conditions for unmarried or divorced people who have not remarried or are confirmed as single, the average monthly income actually received must not exceed 20 million VND; in case the applicant is married, the applicant and his/her spouse must have a total average monthly income actually received of not more than 40 million VND calculated according to the Wage and Salary Table.

In case the subject is unmarried or divorced but not remarried or confirmed to be single and raising children under the age of majority, the average income shall not exceed 30 million VND calculated according to the Wage and Salary Table confirmed by the agency, unit or enterprise where the subject works.

The time to determine income conditions is within 12 consecutive months, calculated from the time the subject submits a valid application to the investor to register to buy or rent-purchase social housing.

The Ministry of Construction also proposed to amend the regulations on interest rates for loans to buy and hire-purchase social housing through the Vietnam Bank for Social Policies as prescribed in Clause 4, Article 48 of Decree No. 100/2024/ND-CP in the direction of studying to reduce the preferential loan interest rate for buying and hire-purchasing social housing (5.4%/year).

The Ministry of Construction is soliciting comments on this draft on the Ministry's Electronic Information Portal.
