Minister of Health Dao Hong Lan has responded in writing to voters' petitions sent to the 9th Session of the 15th National Assembly, regarding the situation of poor quality functional foods and foods of unknown origin.

The Ministry of Health said it is presiding over the drafting of a Decree amending and supplementing a number of articles of Decree 15/2018, and is also studying proposals to amend Decree 115/2018 and Decree 124/2021 to increase sanctions for administrative violations in the field of food safety.
Accordingly, the Ministry of Health proposed to increase the penalty level from 1.2 to 2 times compared to current regulations for some violations such as: Self-declaration or registration of product declaration in violation of regulations; use of raw materials of unknown origin; use of additives or banned substances without permission; violation of conditions for food service business and advertising in violation of regulations.
"Increasing sanctions aims to ensure deterrence, contributing to effectively controlling violations in the field of food safety," the document signed by Minister Dao Hong Lan stated.
In parallel, the Ministry of Public Security is also proposing to amend the Penal Code to increase fines and imprisonment for a number of crimes related to fake and unsafe food.
Minister Dao Hong Lan said that post-inspection of food production and trading establishments is being stepped up. From 2020 to May 2025, the health sector inspected more than 1.9 million establishments, handling over 50,000 violations with a total fine of more than VND247 billion.
In 2025 alone, the Ministry launched a peak campaign to combat counterfeit drugs, milk and health food; issued 8 documents directing localities to strengthen inspection and examination; established 5 surprise inspection teams in the provinces to control the production and trading chains of related products.
The Ministry of Health also coordinates with ministries, branches and local authorities to investigate and destroy fake food production and trading chains.
In the field of advertising, the Law amending and supplementing a number of articles of the Law on Advertising in 2025 (effective from January 1, 2026) adds responsibilities to those who transmit advertising content. Accordingly, individuals and organizations posting must verify the reliability, check documents related to the product and take legal responsibility if the advertisement is false.
The Ministry of Culture, Sports and Tourism is studying proposals to increase fines, temporarily suspend advertising, and publicly announce serious violations. At the same time, it is asking cross-border social media platforms to remove violating content, block accounts, and increase censorship of food advertising content.
