According to an article published in Vietnamnet Newspaper, after 5 years of implementing Resolution 819 of the National Assembly Standing Committee, Ha Tinh province has merged 80 commune-level administrative units in 12 districts, towns and cities, thereby establishing 34 new units, reducing 46 communes.
However, after the merger, dozens of old commune headquarters were abandoned and no longer in use. This situation has lasted from 2020 until now, many of which have seriously degraded due to lack of management and maintenance.
Despite the attention and guidance from many central ministries and branches, the Ha Tinh Department of Finance informed that the province has not yet been able to completely handle these abandoned headquarters. According to the document of the Ministry of Finance sent to the Ha Tinh Provincial People's Committee: The main reason is that the guiding decrees related to the handling of public houses and lands are constantly being revised and supplemented. In particular, according to the new regulations, these surplus headquarters are no longer allowed to be sold.
Regarding the above content, the Department of Public Asset Management (Ministry of Finance) has sent a document to the Department of Finance of Ha Tinh province, requesting this unit to coordinate with relevant agencies to report to the People's Committee of Ha Tinh province and urgently handle surplus houses and land in accordance with the law on public assets in accordance with the direction of the Government leaders.
In addition, the Ministry of Finance has continuously issued many documents guiding localities, including Ha Tinh province, on plans to handle public assets that are not used, used ineffectively or for the wrong purpose.
Regarding the local feedback that the inability to handle abandoned headquarters is due to constantly changing regulations, the Ministry of Finance affirmed that this is true. After the 2024 Land Law took effect from August 1, 2024, the Government issued Decree No. 03/2025/ND-CP dated January 1, 2025, which clearly stipulates that the form of sale is not applicable to assets attached to public land. Therefore, in cases where a decision has been made to approve the sale plan but procedures such as planning adjustment, determination of starting price, etc. have not been completed, the plan must be changed.
Instead of continuing to wait for the auction process to no longer be appropriate, the Ministry of Finance recommends that the People's Committee of Ha Tinh province direct relevant units to quickly develop a rearrangement plan such as: Recovering, transferring, or assigning to organizations with business functions, land fund development organizations for management and exploitation. At the same time, it is necessary to consider land allocation or land lease in accordance with land law. The handling of public assets is not only a requirement for effective management of resources, but also demonstrates the spirit of thrift and anti-waste - which has been repeatedly emphasized by the Government and the Prime Minister in directive documents. However, to effectively implement, the Ministry of Finance believes that: Close coordination between levels, sectors and especially political determination from local authorities is needed.
From the reality in Ha Tinh, it raises important requirements in the work of rearranging the administrative apparatus. If there is no specific reuse plan right from the time of the merger, the post-merger problem such as abandoned headquarters will continue to cause long-term consequences.
Previously, at the working session of the Working Group reviewing the arrangement, layout, and handling of headquarters, projects, and works when streamlining the apparatus and administrative units working with the Hanoi People's Committee, Deputy Minister of Finance Bui Van Khang affirmed: The management and use of public assets is a regular activity according to the Law on Management and Use of Public Assets and Decree 67. However, in the recent mergers at the district and commune levels in many localities, the amount of surplus assets has been very large, posing higher requirements for direction and coordination from competent authorities.
To proactively control the situation, the Prime Minister issued Decision No. 23 on the general inventory of public assets, followed by Directives No. 01 and 02. When entering the implementation phase, the Prime Minister continued to issue Official Dispatches No. 68 and 80 to specify and promote the implementation of the instructions from the Politburo and the Secretariat.
Notably, Party Secretary and Minister of Finance Nguyen Van Thang also sent a document to Provincial and Municipal Party Secretaries and leaders of central ministries and branches, requesting close attention and direction to the implementation process in localities.
