The Ministry of Home Affairs proposes to keep the current number of commune-level staff after the merger.

(VTC News) - According to the latest draft of the Law on Cadres and Civil Servants (amended), the current number of commune-level payrolls will remain the same until the streamlining and restructuring by job position is completed.

The Ministry of Justice has announced the draft Law on Cadres and Civil Servants (amended) drafted by the Ministry of Home Affairs. The draft Law consists of 8 Chapters and 54 Articles; it is expected to be submitted to the National Assembly at the 9th Session.

In the latest draft Law, the Ministry of Home Affairs proposed to amend the concept of cadres and civil servants, which stipulates cadres and civil servants at the central, provincial and communal levels (removing the district level). At the same time, Chapter V on cadres and civil servants at the communal level in the current Law is removed.

Accordingly, the draft Law unifies the management of cadres and civil servants from the central to communal levels, without distinguishing between communal and provincial civil servants, ensuring compliance with the Party's policy on interconnectivity in cadre work.

The drafting agency proposed adding transitional provisions to ensure continuity and not affect the normal operations of people and businesses when implementing the two-level local government model.

Specifically, Article 53 of the draft Law on Cadres and Civil Servants (amended) stipulates: " From the effective date of this Law, commune-level cadres and civil servants as prescribed by the current Law on Cadres and Civil Servants shall maintain the same number of staff until the completion of the review, streamlining, restructuring and arrangement according to job positions of local authorities; and shall retain their current salary level until new jobs are arranged according to Government regulations ."

Within 5 years, provinces and centrally-run cities must arrange, streamline and restructure their staff according to the approved job position plan.

The Ministry of Home Affairs proposes that the Government develop a roadmap and issue regulations to gradually convert management according to job positions within 5 years from the effective date of this Law. During the 5-year period, the management of staff, recruitment, management and use of civil servants will continue to be implemented according to Government regulations.
