Strive to submit to the Government for early issuance of Decree on Land Prices

The 2024 Land Law was passed by the National Assembly on January 18, 2024 and is expected to take effect on January 1, 2025 with many amendments, supplements and new regulations on both state management of land and the rights and obligations of land users.

In this new law, there are many provisions that give the Government the right and responsibility to issue detailed regulations and instructions to ensure effective implementation. Accordingly, the draft Decree detailing a number of articles implementing the Land Law and the draft Decree on Land Price Regulations are two important decrees to demonstrate the above policies.

According to the report of the Ministry of Natural Resources and Environment, as of May 23, 2024, 17/17 Government members agreed with the entire content of the draft Decree on Land Prices. Of which, 4/17 Government members agreed and had other opinions. The draft Decree on Land Prices, after being accepted and completed, has 6 chapters and 41 articles. The Ministry of Natural Resources and Environment has also clarified the accepted contents and explained some contents.

At the same time, the contents that experts, ministries, branches, and provinces focused on discussing were: on supplementing the costs specified in Clause 3, Article 6 of the draft decree, on choosing the method of calculating interest costs and profits of investors specified in Point c and Point d, Clause 3, Article 6 of the draft decree...

The conference also heard reports on Decree 12/2024/ND-CP amending and supplementing a number of articles of Decree 44/2014/ND-CP regulating land prices and Decree 10/2023/ND-CP amending and supplementing a number of articles of decrees guiding the implementation of the Land Law.

Concluding the conference, Deputy Prime Minister Tran Hong Ha emphasized that the draft Decree on Land Prices is the legal basis for determining appropriate land prices according to market principles. He requested the Ministry of Natural Resources and Environment - the agency in charge of drafting the draft decree - to fully absorb the opinions of the delegates, selectively supplement and complete the draft Decree on Land Prices, and strive to submit it to the Government for promulgation as soon as possible to resolve difficulties in determining land prices according to Decree No. 12/2024/ND-CP amending and supplementing a number of articles of Decree No. 44/2014/ND-CP on land prices and Decree No. 10/2023/ND-CP amending and supplementing a number of articles of the decrees guiding the implementation of the Land Law.

In particular, it is noted that the words used in the draft decree must be clear, transparent, easy to understand... to facilitate and unify implementation to ensure fairness and harmony of interests of the State, People, and investors when reclaiming land and clearing sites to implement investment projects.
