The draft Decree on apartment buildings has “paved the way” for the renovation and reconstruction of old projects through planning. Not only that, the State is also ready to take charge of the implementation if no enterprises participate.
On June 27, Deputy Prime Minister Tran Hong Ha chaired a meeting to listen to reports and give opinions on completing the draft Decree detailing a number of articles of the Law on Housing and Reconstruction of Apartment Buildings (Apartment Building Decree).

"Regulations on renovating and rebuilding apartment buildings must be close to reality. Urban planning, plans and housing development programs must be one step ahead," the Deputy Prime Minister emphasized.
According to Deputy Minister of Construction Nguyen Van Sinh, the draft Decree on apartment buildings consists of 8 chapters and 48 articles. In particular, there are incentive mechanisms for businesses participating in the renovation and reconstruction of apartment buildings. In case the project does not have any investors, the State will implement it with budget capital.
The Ministry of Construction will be the unit that sets out scientific criteria, procedures, responsibilities, and authority in inspecting, evaluating, and making a list of apartment buildings that are still in use, have expired, and have a renovation deadline, and are subject to urgent relocation.
Regarding the regulations on selecting investors for renovation and reconstruction projects, a representative of the Vietnam Real Estate Association (VNRea) suggested that in cases where the apartment building has expired or is subject to demolition to ensure safety, the decision does not require the consent of all owners. On the other hand, the remaining cases must still receive the consent of 100% of the owners.
"Priority is given to the option of people negotiating with businesses to carry out projects to renovate and build apartment buildings, but state management agencies must still supervise and ensure the rights of people when approving the project's investment policy," the Deputy Prime Minister noted.
At the meeting, many experts also frankly pointed out some difficulties in renovating and rebuilding apartment buildings. Typically, the issue of ensuring the rights of households, especially those living and doing business on the first floor.
VNRea representative said that many apartment buildings cannot be renovated or rebuilt because the residents on the first floor do not agree to an agreement with the investor. The reason is that these residents are not re-arranged to live on the first floor as before.
Agreeing with this proposal, the Deputy Prime Minister said that the draft Decree needs to clearly stipulate renovation and reconstruction projects that implement on-site resettlement; give priority to households on the first floor to buy or rent the area on the first floor for living and business purposes; and at the same time, develop a set of criteria to determine the coefficient for converting the area of accommodation in old apartments to new apartments.
