When is it exploited outside Vietnam's waters?

Regulations on conditions for fishing outside Vietnam's sea areas are specified in Article 53 of the 2017 Fisheries Law, as follows:

1. Organizations and individuals exploiting aquatic resources outside Vietnamese waters are approved by the Ministry of Agriculture and Rural Development (now the Ministry of Agriculture and Environment ) for fishing vessels exploiting aquatic resources in the waters of other countries or territories or licensed for exploiting aquatic resources in waters under the management of regional fisheries organizations when meeting the following conditions:

a) Permitted by the competent authority of the country or maritime territory or granted quota to Vietnam by the regional fisheries management organization.

b) Fishing vessels must meet operating conditions; be registered, have a Fishing Vessel Technical Safety Certificate valid for at least 06 months; have adequate safety equipment for people and fishing vessels; have appropriate journey monitoring and communication equipment.

c) The captain and chief engineer must have a diploma or certificate issued by a competent authority; crew members and people working on fishing vessels must have insurance and passports; on a vessel or a group of vessels there must be at least one person who can use English or the common language of the country or territory where the fishing vessel is operating; and must not be subject to a ban on exit as prescribed by law.

d) Satisfy other conditions as prescribed by regional, national and other territorial fisheries organizations.
