In his opening speech, Comrade Nguyen Phuong Tuan said that the Draft Law, when submitted to the National Assembly at the 9th Session, received many enthusiastic comments from delegates in both groups and halls. The drafting agency and the reviewing agency promptly received and revised it. To continue to improve, this Workshop focused on clarifying key contents, aiming at the goal of building a synchronous legal framework, promoting science and technology to become a key driving force in socio -economic development.
Many delegates agreed that amending and supplementing the 2013 Law on Science and Technology is urgent in the context that innovation is becoming a core factor of growth. Some of the contents discussed include: Risk acceptance mechanism in research; supporting enterprises to invest in strategic technology; accessing, decoding technology and purchasing technology secrets from abroad.
Overview of the Workshop.
Notably, comments from delegates emphasized the need to clarify specific financial mechanisms, especially the "three-party" coordination model (state - institute - enterprise) in implementing science and technology tasks. According to Dr. Thai Thi Tuyet Dung, Deputy Head of the Inspection and Legal Department, Ho Chi Minh City National University, the Draft Law does not fully mention the State's coordinating role in the three-party linkage. She proposed to add regulations on establishing a coordination mechanism through innovation centers, interdisciplinary councils or regional and provincial cooperation networks, and at the same time recommended clearly defining budget co-financing, tax incentives and ownership of research results.
In addition, delegates also proposed clarifying the mechanism for intellectual property valuation when contributing capital, encouraging capital contribution of patents and useful solutions, especially in cooperation between research institutes and enterprises. Preparing separate financial reports for each task, and independent auditing when there are many sponsors, were also proposed as a measure to increase transparency and efficiency in the use of the state budget.
From a legislative perspective, Comrade Nguyen Tran Phuong Tran - Deputy Head of the Ho Chi Minh City National Assembly Delegation highly appreciated the drafting committee for absorbing comments from previous rounds of comments. The provisions in the Draft Law have been re-presented to be more concise, clearer, open and suitable for management practices. However, he noted the need to ensure consistency between the Law and the implementing guidance documents, avoiding the situation of "open Law - tight guidance". He also gave specific comments on the content of Clause 5, Article 54 related to the concept of "outstanding scientist ", saying that it is necessary to avoid duplication in content.
At the workshop, Mr. Nguyen Nam Hai, Director of the Department of Planning and Finance, Ministry of Science and Technology , said that the Draft Law on Science, Technology and Innovation currently consists of 8 chapters and 83 articles (2 articles more than the current Law), in which the content on innovation is added and the structure is adjusted to better suit the actual situation. He also acknowledged each comment at the workshop and directly discussed and clarified any remaining issues.
In his concluding remarks at the workshop, the representative of the Committee on Science, Technology and Environment affirmed that they will continue to closely coordinate with the Ministry of Science and Technology and relevant agencies to review and complete the Draft Law on Science, Technology and Innovation, and submit it to the National Assembly Standing Committee for consideration in the coming time. The drafting committee hopes that delegates will continue to accompany and contribute their opinions to ensure that the Draft Law, once approved, will soon come into effect, promote practical effectiveness, and meet the requirements of national development in the new period.
