Two multi-year residential projects

In Long An province, there are residential projects that have been implemented for a long time but are still entangled in legal issues, affecting the legitimate rights of the people. Notable among them are the Residential Project of ADEC Joint Stock Company in Tan An City and the Go Den Residential Project of Real Estate Joint Stock Company 6 (formerly Go Mon Real Estate Company) in Ben Luc District. Currently, the provincial authorities are working together to remove difficulties and complete legal procedures to ensure the rights of residents living in the area.

Prolonged problems at the Residential Area project in Tan An City

The Residential Area Project opposite Long An General Hospital (in Ward 3, Tan An City) invested by ADEC Joint Stock Company, was approved for investment by Long An Provincial People's Committee in 2001, adjusted in 2003 with a scale of about 9.6 hectares.

The company has compensated about 6.3 hectares, of which about 2.6 hectares are adjacent to the land plot and have been invested in technical infrastructure; the remaining 3.7 hectares are not adjacent to the land plot. At the same time, about 3.3 hectares have not been cleared.

To date, the company has sold 174 plots, of which 104 plots (64 resettlement plots and 40 commercial plots) are in the 2.6ha area with invested infrastructure and the remaining 70 plots (24 resettlement plots and 46 commercial plots) are outside this area.

Although the company has been granted 4 Land Use Right Certificates (LURCs) for the 2.6ha area with infrastructure investment, these certificates do not match the detailed planning map at a scale of 1/500 approved by the Provincial People's Committee. This has caused the division of land plots and the granting of LURCs to people to be delayed. Notably, some cases of resettled people or those who received the transfer of commercial plots outside the boundary of the 2.6ha area with infrastructure investment are not eligible for LURCs.

To resolve the problems, in June 2025, Tan An City People's Committee will coordinate with investors and relevant agencies to review and approve the adjustment of the detailed planning 1/500. According to the plan, in the third quarter of 2025, the Department of Agriculture and Environment will guide investors to carry out procedures for granting land use right certificates to households. In 2025, the Department of Finance will coordinate with departments, branches and localities to request investors to carry out procedures to submit to the Provincial People's Committee for a decision to reduce the project area.

Go Den Residential Area Project "suspenses" people's rights

The Go Den Residential Area Project, Phuoc Loi Commune, Ben Luc District, invested by Go Mon Real Estate Company (now Real Estate Joint Stock Company 6), was approved for detailed planning 1/500 in 2003 with a scale of about 20.2 hectares. In 2004, the Provincial People's Committee allocated about 18.6 hectares of land to the investor. By 2009, the area was adjusted down to 15.6 hectares.

The Company has not yet adjusted the detailed planning according to the change in area and has not completed the construction of the technical infrastructure system. Currently, the Company has issued 5 land use right certificates for about 14 hectares; has not completed the compensation and site clearance of the project, and has not completed the construction of the infrastructure system. The Company still has 86 land plots that have not completed the transfer of land use rights to the people.

Of which, there are 19 cases in the resettlement area that have not been granted land use right certificates because Real Estate Joint Stock Company 6 did not cooperate (Long An province authorities could not contact the investor) to carry out procedures to transfer land use rights to the people.

Currently, people in the area have been complaining and suing for a long time because they have not been granted land use right certificates, so they cannot build or repair houses on land within the project's planning area. Through verification by the police, Real Estate Joint Stock Company 6 is no longer operating at the address stated in the Business Registration Certificate.

In May 2025, the Department of Finance of Long An province sent a document to the Ho Chi Minh City Business Registration Office to verify the operating status of Real Estate Joint Stock Company 6. The project has no investment policy, so it cannot be terminated according to the Investment Law (previously implemented according to planning and land allocation decisions). In 2025, the Department of Agriculture and Environment will preside over and coordinate with relevant sectors to consider granting land use right certificates to people living in the area.

Handling residential projects that have lasted for many years is not only an urgent requirement to ensure the legitimate rights of the people, but also an important step in tightening discipline and improving the effectiveness of State management in the investment and construction sector.

The province is strongly determined to review and thoroughly handle "suspended" projects, thereby freeing up land resources and promoting sustainable urban development./.
