The authority to issue a certificate of newly established enterprise is performed by the People's Committee of the province where the enterprise has its head office.
The draft Circular proposes regulations on the authority, order and procedures for certifying newly established enterprises from investment projects to produce products on the List of high-tech products encouraged for development issued by the Prime Minister (newly established enterprises) and certifying high-tech incubators and high-tech enterprise incubators (high-tech incubators).
Issuance of new business establishment certificate
According to the draft, the issuance of a certificate of newly established enterprises from investment projects to manufacture products in the List of high-tech products encouraged for development as prescribed in Clause 1, Article 3 of Circular No. 33/2011/TT-BKHCN dated December 9, 2011 of the Minister of Science and Technology guiding on the authority, order and procedures for certifying newly established enterprises from projects to manufacture products in the List of high-tech products encouraged for development (Circular No. 33/2011/TT-BKHCN) shall be carried out by the People's Committee of the province where the enterprise has its head office.
Procedures for granting a Certificate of New Business Establishment
The order and procedures for granting a Certificate of newly established enterprise from an investment project to manufacture products on the List of high-tech products encouraged for development are specified in the Appendix issued with this Circular.
Specifically, the dossier includes: Application for a Certificate of Establishment of a newly established enterprise; certified copy of the Certificate of Business Registration or Certificate of Investment Registration; explanation of the enterprise meeting the criteria for investment projects to produce high-tech products.
The application for a certificate of newly established enterprise is made in Vietnamese and made into 01 original, 01 copy and 01 electronic copy submitted directly or sent by post to the Provincial People's Committee, including 01 set of records and 01 set of records for procedures according to the provisions of this Circular.
Within 05 working days from the date of receiving the dossier, the Provincial People's Committee is responsible for reviewing the completeness and validity of the dossier.
In case the dossier is incomplete or invalid, within 05 working days, the Provincial People's Committee shall issue a written request for the enterprise to supplement and complete the dossier. Within 10 working days from the date of receipt of the written request for supplementation and completion of the dossier, the enterprise shall be responsible for supplementing and editing the dossier and sending it back to the Provincial People's Committee. If after the above deadline the enterprise fails to supplement and complete the dossier or the supplementation and completion do not meet the requirements, the Provincial People's Committee shall issue a written refusal to issue a certificate to the enterprise.
Within 30 working days from the date of receipt of a complete and valid dossier, the Provincial People's Committee shall be responsible for organizing an appraisal or establishing an appraisal advisory council in accordance with the regulations of the Provincial People's Committee. Within 15 working days from the date of the appraisal conclusion, the Provincial People's Committee shall be responsible for issuing a certificate and sending it to the enterprise. In case of refusal to issue a certificate, the enterprise must be notified of the reason in writing.
