(Chinhphu.vn) - The Ministry of Justice has issued Circular 08/2025/TT-BTP regulating the decentralization of authority of local authorities at two levels and decentralization in the field of state management of the Ministry of Justice.

This Circular provides for the division of authority, guidance on the implementation of tasks, order and procedures for performing tasks and authorities when organizing a two-level government; decentralization and order and procedures for performing a number of decentralized tasks of units under the Ministry of Justice ; forms for performing administrative procedures in a number of state management areas of the Ministry of Justice.

Authority, order and procedures for household registration

According to the Circular, the authority, order and procedures for household registration of the People's Committee at the commune level are prescribed as follows:

The People's Committees of communes, wards and special zones (Commune-level People's Committees) exercise the authority to register civil status as prescribed in Clause 2, Article 8, Clause 2, Article 11, Clause 1, Article 15, Clause 1, Article 20, Clause 2, Article 22 of Circular No. 04/2020/TT-BTP dated May 28, 2020 of the Minister of Justice detailing the implementation of a number of articles of the Law on Civil Status and Decree No. 123/2015/ND-CP dated November 15, 2015 of the Government detailing a number of articles and measures to implement the Law on Civil Status as amended and supplemented in 2022 and 2024 (Circular No. 04/2020/TT-BTP).

The People's Committee at the commune level shall receive and handle the civil status registration prescribed in Clause 1 of this Article according to the order and procedures for handling civil status registration prescribed in Article 5 of Decree No. 120/2025/ND-CP dated June 11, 2025 of the Government regulating the division of authority of local authorities at 02 levels in the field of state management of the Ministry of Justice (Decree No. 120/2025/ND-CP) and related regulations in Circular No. 04/2020/TT-BTP.

When implementing the procedures prescribed in Clause 1, Article 11, Clause 3, Article 15, Clause 1, Article 20 of Circular No. 04/2020/TT-BTP, the tasks of the District People's Committee and the District Justice Department will be transferred to the Commune People's Committee and the civil status - judicial officials.

Receiving documents and returning results of household registration

Receiving documents and returning results of household registration are carried out according to the provisions of Clause 1 and Clause 2, Article 3 of Circular No. 04/2020/TT-BTP and the following provisions:

1- A person requesting civil status registration can submit a certified copy of the original or a copy issued from the original book (copy) or a photocopy with the original or electronic copy of these documents, including integrated documents, displayed on the Electronic Identification Application (VNeID).

In case the requester submits a photocopy along with the original document, the recipient is responsible for checking, comparing the photocopy with the original and signing confirmation, and is not allowed to request submission of a copy of that document.

For documents presented when registering for civil status, the recipient is responsible for checking, comparing, recording information or taking photos and signing confirmation to keep in the file and returning to the person presenting, and is not allowed to request to submit copies or photocopies of those documents.

2- When returning the results of marriage registration or re-registration of marriage, both the man and woman must be present; the person returning the results is responsible for guiding the person requesting marriage registration to check the content of the Marriage Certificate and the Marriage Registration Book.

If both the man and woman find the content correct and consistent with the marriage registration file, they must sign and clearly state their full names in the Marriage Certificate and Marriage Registration Book according to the instructions of the person returning the results.

This Circular takes effect from July 1, 2025.
