Implementing the two-level local government model, many difficulties and shortcomings in educational management at the grassroots level have arisen, especially the arrangement of officials without educational expertise to be in charge of this field at the commune level. According to the Department of Education and Training, the whole province has only 23/54 communes, wards, and special zones with civil servants specializing in education (accounting for 42%). A commune-level education official has to shoulder too much work (the work was previously undertaken by the district-level Department of Education and Training with about 5-8 civil servants and 10-20 key officials recruited and seconded from educational institutions).
To remove difficulties for localities in education and training, on August 15, 2025 , the Ministry of Education and Training issued an official dispatch to the provincial People's Committee, stating that while waiting for the Government to issue a decree replacing Decree No. 62/2020/ND-CP on job positions and civil servant payrolls, the provincial People's Committee, within its assigned scope and authority, proactively directs and guides localities based on the functions and tasks of the grassroots level, to reasonably allocate civil servant payrolls at the provincial and commune levels to ensure sufficient quantity and quality. Along with that, there are appropriate solutions to mobilize civil servants who have previously worked at the Department of Education and Training or to receive and second educational managers and teachers at all levels with appropriate expertise and experience to arrange them into job positions in charge of the field of education and training at the commune level if they meet the prescribed conditions.
In addition, direct the Department of Education and Training to preside over and coordinate with relevant departments and branches to proactively grasp difficulties and obstacles in the field of education and training when implementing two-level local government, promptly have solutions to remove them or report to competent authorities to remove them; organize training and fostering for the team of commune-level civil servants in charge of the field of education and training to ensure that there are no gaps or overlaps in management content and that management content and methods are clear.
The Department of Education and Training shall take the lead in recruiting, receiving, mobilizing, seconding, and transferring teachers and staff in educational institutions in the province. The Chairman of the Commune People's Committee shall only carry out the recruitment and use of civil servants if delegated. In the context that the number of commune-level civil servants in charge of education and training is currently insufficient, and many of them have no experience in state management of education, decentralizing the Department of Education and Training to take the lead in recruiting, receiving, mobilizing, seconding, and transferring teachers and staff in educational institutions in the province is appropriate.
To ensure the provision of sufficient numbers of teachers, staff and workers in public educational institutions for the 2025-2026 school year, the Ministry of Education and Training requests that the provincial People's Committees pay attention to maintaining stability and ensuring the staff of teachers, staff and workers in educational institutions in preparation for the 2025-2026 school year. In cases where recruitment has not been carried out, the provincial People's Committees shall consider, allocate funds and sign labor contracts or mobilize, second, and arrange inter-school and inter-level positions to ensure sufficient staff for the new school year.
Implementing the quota of students/class in primary and secondary schools for special cases where the number of students/class must be arranged lower or higher than the average level by region as prescribed in Clause 2, Article 3 of Circular No. 20/2023/TT-BGDDT, the Provincial People's Committee shall decide on the quota of students/class in accordance with reality.
Based on the document of the Ministry of Education and Training, the Department of Education and Training is actively advising the Provincial People's Committee on tasks and state management of education in the province effectively, in accordance with the 2-level government model.
