Accordingly, in this Circular, the Ministry of Health provides guidance on the authority to select key surveillance locations as prescribed in Clause 1, Article 15 of Circular No. 07/2023/TT-BYT dated April 4, 2023 of the Minister of Health guiding the process and methods of HIV/AIDS epidemiological surveillance and surveillance of sexually transmitted diseases by the provincial focal point for HIV/AIDS prevention and control.
Regarding the authority to advise on organizing and implementing activities to respond to the prevention and control of infectious diseases and epidemics in the area according to the provisions of Clause 2, Article 12 of Circular No. 17/2019/TT-BYT dated July 17, 2019 of the Minister of Health guiding the monitoring and response to infectious diseases and epidemics by specialized health agencies under the People's Committees at the commune level.
Regarding the authority to manage and inspect the situation of occupational hygiene and health of workers at labor establishments in the area according to the decentralization as prescribed in Clause 1, Article 16 of Circular No. 19/2016/TT-BYT dated June 30, 2016 of the Minister of Health guiding the management of occupational hygiene and health of workers, implemented by the Provincial Center for Disease Control.
The Ministry of Health stated that the authority to advise on organizing and implementing activities to respond to the prevention and control of infectious diseases and epidemics in the area as prescribed in Clause 2, Article 12 of Circular No. 17/2019/TT-BYT dated July 17, 2019 of the Minister of Health guiding the monitoring and response to infectious diseases and epidemics is carried out by specialized health agencies under the People's Committees at the commune level. Regarding decentralization in the field of disease prevention , the Ministry of Health clearly stated that it receives dossiers for registration of declarations of conformity and issues certificates of acceptance of declarations of conformity based on the results of conformity certification by a designated conformity certification organization (third party) for tobacco.
Accordingly, the authority to receive dossiers for registration of declaration of conformity, issue certificates of acceptance of declaration of conformity based on the results of conformity certification by the designated conformity certification organization (third party) for tobacco as prescribed in Clause 1, Article 7 of Circular No. 49/2015/TT-BYT dated December 11, 2015 of the Minister of Health regulating the declaration of conformity and declaration of compliance with regulations for tobacco is amended and supplemented in Circular No. 17/2023/TT-BYT dated September 25, 2023 of the Minister of Health amending, supplementing and abolishing a number of legal documents on Food Safety issued by the Minister of Health shall be implemented by specialized health agencies under the People's Committees of the provincial level.
The dossier, order and procedures for registration and receipt of dossiers for registration of declaration of conformity based on the results of conformity certification by a designated conformity certification organization (third party) for tobacco shall comply with the provisions in Part 1 of the Appendix issued with the Circular.
Regarding receiving dossiers for registration of declaration of conformity, issuing certificates of acceptance of declaration of conformity based on self-assessment results of organizations and individuals producing and trading tobacco (first party) for tobacco.
The authority to receive dossiers for registration of declaration of conformity and issue certificates of acceptance of declaration of conformity based on the self-assessment results of organizations and individuals producing and trading tobacco (first party) for tobacco as prescribed in Clause 1, Article 7 of Circular No. 49/2015/TT-BYT amended and supplemented in 2023 shall be implemented by specialized health agencies under the People's Committees of the provincial level.
The dossier, order and procedures for receiving dossiers for registration of declaration of conformity, granting certificates of acceptance of declaration of conformity based on the self-assessment results of organizations and individuals producing and trading tobacco (first party) for tobacco shall comply with the provisions in Part 2 of the Appendix issued with this Circular.
Regarding receiving dossiers for re-registration of declarations of conformity, re-issuance of certificates of acceptance of declarations of conformity for tobacco, the authority to receive dossiers for re-registration of declarations of conformity, re-issuance of certificates of acceptance of declarations of conformity for tobacco according to the provisions of Clause 2, Article 8 of Circular No. 49/2015/TT-BYT amended and supplemented in 2023 shall be implemented by specialized health agencies under the People's Committees of the provincial level.
The dossier, order and procedures for receiving dossiers for re-registration of declaration of conformity, re-issuance of certificate of receipt of declaration of conformity based on the self-assessment results of organizations and individuals producing and trading tobacco (first party) for tobacco shall comply with the provisions in Part 2 of the Appendix issued with this Circular.
According to the Ministry of Health, this Circular takes effect from July 1, 2025 and expires from March 1, 2027. During the effective period of this Circular, if the provisions on authority and responsibility for state management in this Circular are different from the Circulars issued by the Minister of Health before July 1, 2025, the provisions in this Circular shall apply.
The Ministry of Health stated that for dossiers submitted before the effective date of this Circular: The dossier receiving agency shall continue to process them according to current regulations until the administrative procedure is completed.
District, town, provincial city, city directly under the province, city directly under the central city, and commune-level health stations shall continue to implement the reporting regime until the Ministry of Health issues replacement instructions.
