Ministry of Home Affairs guides the implementation of regimes and policies according to Decree 178 and Decree 67.

The Ministry of Home Affairs has issued a document on resolving difficulties and problems in implementing regimes and policies according to Decree 178/2024/ND-CP and Decree 67/2025/ND-CP with 4 contents of interest.

On August 27, the Ministry of Home Affairs issued Official Dispatch 7164/BNV-TCBC regarding difficulties and obstacles in implementing regimes and policies according to Decree 178/2024/ND-CP and Decree 67/2025/ND-CP.

Accordingly, in response to Official Dispatch 6560/SNV-CCVC dated August 22, 2025 of the Department of Home Affairs of Hai Phong City on guiding some difficulties and problems when implementing Decree 178/2024/ND-CP (amended and supplemented a number of articles in Decree 67/2025/ND-CP), the Ministry of Home Affairs has opinions on the following 4 contents.

First, about the subject of the labor contract

Pursuant to the provisions of Point c, Clause 1, Article 2 of Decree 178/2024/ND-CP (amended and supplemented by a number of articles in Decree 67/2025/ND-CP), in the case of a contract for a janitor, driver, security guard, technician..., the subject is regulated in this Decree.

Therefore, these cases, after being merged, rearranged, or reorganized, are determined to be redundant and are subject to consideration and application of policies and regimes according to the provisions of Decree 178/2024/ND-CP (amended and supplemented by a number of articles in Decree 67/2025/ND-CP).

Second, for civil servants in public education and health care units

According to the guidance of the Steering Committee on summarizing the implementation of Resolution 18-NQ/TW of the Government in 2017 in Official Dispatch 68/CV-BCĐ dated May 28, 2025, in the immediate future, it is necessary to maintain the stability of the system of public service units in the fields of education and health in the locality, only make arrangements when really necessary and do not affect the activities serving the essential needs of local people.

Accordingly, in case of necessity and without affecting the activities serving the essential needs of the people in the locality, the locality shall merge, arrange and reorganize the affiliated public service units (including public service units in the fields of education and health) to reduce the focal points of public service units according to the requirements of Resolution 18-NQ/TW, the unit directly implementing the merger and consolidation plan shall be identified as the unit directly implementing the organizational arrangement to consider applying policies and regimes according to the provisions of Decree 178/2024/ND-CP (amended and supplemented by a number of articles in Decree 67/2025/ND-CP).

Third, for those who have worked at agencies and units directly implementing the arrangement (merger, consolidation, dissolution, etc.), but have been accepted and assigned new jobs at agencies and units that did not implement the arrangement, and now wish to resign, based on the provisions of Decree 178/2024/ND-CP (amended and supplemented by a number of articles in Decree 67/2025/ND-CP), they are not eligible for consideration of policies and regimes according to the provisions of this Decree.

Fourth, for some cases of commune-level leaders and civil servants who were appointed after the arrangement, due to health conditions that are not guaranteed, the quality of work is affected.

After the new commune-level government is established (the administrative unit directly affected by the organizational arrangement according to the requirements of the Central Steering Committee on the summary of Resolution 18-NQ/TW) and comes into stable operation, the competent authority at the local level will only consider and resolve the resignation according to the provisions of Decree 178/2024/ND-CP (amended and supplemented by a number of articles in Decree 67/2025/ND-CP) for cases of leaders and civil servants at the commune level when their health is not guaranteed and they cannot meet the requirements of the task to create favorable conditions for arranging, rotating and appointing young leaders and civil servants with professional qualifications, skills and practical capacity, who can immediately meet the requirements of the assigned work.

Information on the settlement of regimes and policies for cadres, civil servants and public employees of the Ministry of Home Affairs shows that, as of August 19, 2025, the total number of people who have decided to quit their jobs is 94,402 people; the total number of people who have quit their jobs (retired and quit) is 81,995 people; the total number of people who are submitting to competent authorities for approval of funding and have been approved is 81,410 people (of which 50,345 people have received money).

Pursuant to Conclusion No. 183-KL/TW of the Politburo and the Secretariat, the preparation of the list and issuance of decisions on resignation for subjects according to Decree No. 178/2024/ND-CP must be completed before August 31, 2025, the latest date for resignation to enjoy policies and regimes is September 1, 2025; after this date, it will end.
