Raising the issue of how goods of Vietnamese origin are understood, Ms. Trinh Thi Thu Hien - Deputy Director of the Import-Export Department ( Ministry of Industry and Trade ) - cited the case of Samsung, a Korean brand, but with a processing factory in Vietnam, which clearly means that this is a Korean phone product, not a Vietnamese phone.

Where do Korean brands made in Vietnam come from?

“The question is, are Samsung phones made in Vietnam?” Ms. Hien raised the issue that if we consider the regulations related to the set of origin criteria that Vietnam participates in within the framework of free trade agreements, Samsung phones are manufactured in Vietnam from components made in Vietnam or imported components.

However, after going through the full processing and manufacturing process in Vietnam, the nature of those components has changed into the final phone product.

Therefore, the place where such a change in nature takes place is determined to be the place of origin of the goods.

From Samsung's story, the leader of the Import-Export Department said that it is necessary to clearly distinguish the concept of goods originating from Vietnam, with a certificate of Vietnamese origin according to the agreement frameworks that Vietnam participates in, from the concepts of labeling "Made in Vietnam", "Product of Vietnam" or concepts related to whether they are Vietnamese or Korean goods.

In fact, Vietnam has many regulations on the origin of goods, regulations on what a product is considered to have originated in Vietnam, but they only apply to imported and exported goods and do not have a legal basis for domestically circulated goods. This causes difficulties and confusion for consumers, management agencies and businesses.

Identify six criteria of origin

From that reality, the representative of the Department of Goods Origin - Import-Export Department (Ministry of Industry and Trade) said that the set of criteria for determining goods produced in Vietnam is expected to be based on value content and the main production stages must be carried out in Vietnam.

Specifically, the first is pure origin including products of cultivation, livestock, mining, fishing, recycling... created entirely in Vietnam.

The second is production from Vietnamese materials, including goods produced in Vietnam from all materials originating from Vietnam.

Third is processing and manufacturing that makes fundamental changes: Using imported materials but if the final stage in Vietnam changes the customs code - HS code or reaches the Vietnamese value ratio (VVC) according to regulations.

Fourth , simple processing and manufacturing steps are not accepted: for example, packaging, labeling, simple assembly, simple mixing, etc.

Fifth , raw materials that do not meet CTC requirements are still considered Vietnamese goods if the value of raw materials without origin is less than or equal to 15% of the factory price.

Sixth , factors that do not need to be considered: factors that do not count towards the origin of goods such as fuel, catalysts, testing equipment, uniforms, safety equipment, etc.

However, Ms. Bui Thi Thuy Duong - Department of Quality Management and Conformity Assessment, National Committee for Standards and Quality ( Ministry of Science and Technology ) - said that developing criteria to identify "made in Vietnam" goods is very necessary, but needs to be flexibly designed, have a roadmap, be classified by industry group or risk and consult widely.

According to Director of the Import-Export Department Nguyen Anh Son, in the context of the increasing number of counterfeit goods, goods of unknown origin, and goods of unknown origin in the domestic market, it directly affects the health and interests of consumers, seriously violating the image and reputation of products of Vietnamese origin.

Therefore, the set of criteria aims to complete the legal framework on the origin of goods for domestically circulated goods, as a basis for businesses to determine the content and origin status of goods when circulating on the market; reduce trade fraud, origin evasion, and increase trust in Vietnamese goods.
