Circular regulating the decentralization and division of authority of local authorities at two levels in the fields of culture, sports and tourism; procedures and order of implementation when decentralizing and dividing authority.

Decentralization in the field of culture, sports and tourism

About organizing mass sports competitions:

The organization of regional, continental and world-level sports competitions in Vietnam for people with disabilities; national mass sports competitions as prescribed in Clause 3, Article 13 of the Law on Physical Training and Sports, amended and supplemented by the Law on amending and supplementing a number of articles of the Law on Physical Training and Sports, shall be decided by the Vietnam Department of Physical Training and Sports.

About organizing high-performance sports competitions:

The organization of regional, continental and world championships and youth championships in each sport held in Vietnam; annual national championships and youth championships in each sport as prescribed in Clause 2, Article 38 of the Law on Physical Training and Sports as amended and supplemented by the Law on Amending and Supplementing a Number of Articles of the Law on Physical Training and Sports shall be decided by the Vietnam Sports and Physical Training Department.

Issue the rules of the sport:

The decision to promulgate the competition rules of a sport or the decision to apply the competition rules of a sport promulgated by an international sports federation as prescribed in Clause 2, Article 38a of the Law on Physical Training and Sports, amended and supplemented by the Law amending and supplementing a number of articles of the Law on Physical Training and Sports, is decided by the Vietnam Sports and Physical Training Department.

Approval of the Charter of high-performance sports tournaments:

The approval of the Charter of high-performance sports competitions stipulated in Clause 2, Article 39 of the Law on Physical Training and Sports, amended and supplemented by the Law amending and supplementing a number of articles of the Law on Physical Training and Sports, is decided by the Vietnam Sports and Physical Training Department.

Approval of the Charter of high-performance sports competitions in cases where a national sports federation has not yet been established. The Law on Physical Training and Sports is amended and supplemented by the Law amending and supplementing a number of articles of the Law on Physical Training and Sports, decided by the Vietnam Sports and Physical Training Department.

Re-registration of publishing activities:

The re-registration of publication distribution activities of the publishing establishment as prescribed in Clause 2, Article 18 of Circular No. 01/2020/TT-BTTTT dated February 7, 2020 of the Minister of Information and Communications detailing and guiding the implementation of a number of articles of the Publishing Law and Decree No. 195/2013/ND-CP dated November 21, 2013 of the Government detailing a number of articles and measures to implement the Publishing Law, amended and supplemented by Circular No. 23/2023/TT-BTTTT dated December 31, 2023 of the Minister of Information and Communications, shall be carried out by the People's Committee of the province where the publishing establishment has its head office or branch.

Adjusting and supplementing information in the license to establish a representative office of a foreign publisher or foreign publication distribution organization:

Adjusting and supplementing information in the license to establish a representative office when there is a change in the provisions of Article 21 of Circular No. 01/2020/TT-BTTTT amended and supplemented by Circular No. 23/2023/TT-BTTTT shall be implemented by the Provincial People's Committee.

Delimitation of authority in the fields of culture, sports and tourism

Responsibility for managing advertising activities in the area:

The implementation of the responsibility for managing advertising activities in the area as prescribed in Article 10 of Circular No. 10/2013/TT-BVHTTDL dated December 6, 2013 of the Minister of Culture, Sports and Tourism detailing and guiding the implementation of a number of articles of the Law on Advertising and Decree No. 181/2013/ND-CP dated November 14, 2013 of the Government detailing the implementation of a number of articles of the Law on Advertising shall be carried out by the People's Committees at the commune level.

Collect and report information on family and domestic violence prevention:

The collection and reporting of information on family and prevention and control of domestic violence as prescribed in Clause 4, Article 5 of Circular No. 07/2017/TT-BVHTTDL dated December 29, 2017 of the Minister of Culture, Sports and Tourism regulating the collection and reporting of information on family and prevention and control of domestic violence shall be carried out by the People's Committee at the commune level.

Receiving reports on organizing grassroots sports competitions:

The reception of reports on the organization of grassroots mass sports competitions as prescribed in Clause 4, Article 8 of Circular No. 09/2012/TT-BVHTTDL dated November 19, 2012 of the Minister of Culture, Sports and Tourism regulating the organization of grassroots mass sports competitions shall be received by the People's Committee at the commune level.

The Circular takes effect from July 1, 2025.

The provisions of this Circular shall cease to be effective from March 1, 2027, except in the following cases:

a) The Decree regulating decentralization and delegation in the fields of culture, sports and tourism; the Decree regulating the decentralization of authority of local authorities at 02 levels in the fields of culture, sports and tourism proposed by the Government and decided by the National Assembly to extend the application period in whole or in part, in which, the content related to the provisions of this Circular is allowed to extend the application period.

b) Laws, resolutions of the National Assembly, ordinances, resolutions of the National Assembly Standing Committee, decrees, resolutions of the Government, decisions of the Prime Minister containing provisions on the authority, responsibility for state management, order and procedures prescribed in this Circular are adopted or promulgated from July 1, 2025, and take effect before March 1, 2027, then the corresponding provisions in this Circular shall cease to be effective at the time such legal documents take effect.
