A New York (US) judge on January 6 rejected President-elect Donald Trump's request to postpone the sentencing hearing in his criminal case, scheduled for January 10.
According to ABC News, lawyers for US President-elect Trump argued that the court "should cancel the sentencing hearing scheduled for January 10 and postpone all further deadlines in the case until Mr. Trump's appeal of immunity is fully and conclusively resolved." This argument was made in a court filing and announced by New York Judge Juan Merchan on January 6.

However, Judge Merchan rejected that request in a ruling late on January 6. "The court has reviewed the defendant's arguments and finds that they are largely a rehash of arguments that have been made many times before," Merchan wrote.
Manhattan District Attorney Alvin Bragg’s office urged the judge earlier on Friday to deny the request to delay the sentencing. Prosecutors noted that the final ruling would allow Trump to continue his appeals in the case. They argued that the sentencing must now take place because Trump has repeatedly requested delays since July 2024.

In a statement, Steven Cheung, a spokesman for President-elect Trump, called the planned sentencing “unlawful.” “The Supreme Court’s historic decision on immunity, the New York State Constitution, and other established legal precedents require that this baseless hoax be immediately dismissed,” Cheung said.
In May 2024, Donald Trump was charged with 34 counts of falsifying business records, making him the first former president to be convicted of a crime. The case involved an alleged attempt to conceal hush money payments to adult film star Stormy Daniels before the 2016 presidential election.
The sentencing was delayed several times due to the 2024 US presidential election and Mr Trump’s efforts to dismiss the case based on claims of presidential immunity. Judge Juan Merchan ultimately rejected the immunity argument in December 2024.
Judge Merchan said on January 3 that he intended not to impose a prison sentence because prosecutors "admitted they no longer considered (a prison sentence) a viable proposition" after Mr. Trump's election victory.
Mr Trump’s team has not commented on whether the incoming leader will appear in court. Mr Trump has been allowed to appear in person or online for the hearing, which is scheduled for January 10.
