Implementing the assignment of the Government, the Ministry of Agriculture and Environment presides over reviewing, synthesizing, and drafting the Law amending and supplementing a number of articles of the 2024 Land Law to submit to the National Assembly for consideration at the October 2025 session. The 2024 Land Law takes effect from August 1, 2024, amending and supplementing a number of articles of the 2013 Land Law with many important changes, especially regulations related to planning and land use plans; land allocation and lease; land finance and land prices... The Law also stipulates more clearly the rights of people when their land is recovered, ensuring fairness in compensation, support, and resettlement.
After nearly a year of implementation, the Law and its guiding documents have come into effect, contributing to promoting socio-economic development and ensuring national defense and security. Many administrative procedures have been reformed, state management contents have been updated, and resources for the country have been liberated. However, in the current context, the requirement to perfect land management institutions is increasingly high; in particular, the implementation of a two-tier local government model, deeper decentralization and delegation of power, and strong administrative reform in the land sector require continued amendments and supplements to the current Law.
The Draft Law amending and supplementing a number of articles of the 2024 Land Law is designed to fully and promptly institutionalize the viewpoints and policies of the Party and State on land policy; at the same time, ensure the continuity, stability and unity of the legal system; promptly remove "bottlenecks" and handle new issues arising from practice.
Major groups of contents that have been revised and supplemented include: Land use planning and plans in accordance with the two-level government model; land recovery for national defense, security, socio-economic development for national and public interests; basis and authority for land allocation, land lease, and land use purpose conversion; determination of residential land area when recognizing land use rights; basis for calculating land use fees, land rent, application of land price list, land price adjustment coefficient; decentralization of land area management of agricultural and forestry companies handed over to localities; plot separation and consolidation; completion, operation, data update, maintenance, and upgrading of the national land information system; unification of drafting techniques, ensuring consistency with specialized laws, and overcoming legal gaps.
At the meeting, representatives of ministries, branches and localities discussed and gave opinions on the plan for planning and land use at the commune level; regulations on land recovery; land price list and financial obligations; auction of land use rights; authority to allocate, lease land and handle public assets on land...
Concluding the conference, Deputy Prime Minister Tran Hong Ha acknowledged and highly appreciated the contributions of localities, ministries, branches, agencies and units. He also affirmed the important role and significance of the Land Law and the amendment and supplementation of a number of articles of the draft Law in response to current practical requirements. He requested the Ministry of Agriculture and Environment to immediately review the conclusions of the Party Central Committee to ensure that the draft Law is drafted in line with the direction. The Law needs to specifically decentralize the land management role of the commune, province and central levels, avoid overlaps and obstacles, and ensure a unified and flexible operating mechanism, especially in the planning, strategy and land valuation stages.
The Deputy Prime Minister requested agencies and localities to continue researching and synthesizing proposals to send to the Ministry of Agriculture and Environment; in which attention should be paid to the contents of practical difficulties and shortcomings arising in localities. At the same time, he requested the drafting agency to review, objectively and fully absorb comments to complete the draft Law amending and supplementing a number of articles of the 2024 Land Law, and submit it to the National Assembly for consideration at the October 2025 session.
